【摘要】:中國傳統(tǒng)社會法律屬性的演變可以歸結(jié)為兩個階段,一是從先秦到漢唐的倫理法階段,二是從宋到清的義理法階段。宋明理學實現(xiàn)了由倫理法律化到法律義理化的轉(zhuǎn)變,其義理法屬性突出體現(xiàn)在"法者因天理","國法"具有依靠、源于、支撐維護以及因襲順應"天理"等含義,強調(diào)了"天理、國法、人情"三位一體的現(xiàn)實理性追求。
[Abstract]:The evolution of the legal attributes of Chinese traditional society can be summed up into two stages, one is the ethical law stage from pre-Qin to Han and Tang dynasties. From Song to Qing Dynasty, Song Ming realized the transformation from ethical legalization to legal justice, and its legal attributes were mainly reflected in the nature of the law, and the national law had its dependence and origin. Supporting and maintaining and conforming to the meaning of "Heaven", it emphasizes the realistic rational pursuit of "heaven, national law, human".
