【摘要】：近些年來，隨著各種食品安全問題的不斷涌現(xiàn)，老百姓們對日常消費(fèi)的食品安全問題開始日益關(guān)注，，在此同時(shí)國家也加大了力度來對食品安全問題進(jìn)行監(jiān)督管理和整治�！叭埂蹦谭凼录萌珖舷虏唤麌W然，然而這也只是冰山一角，屢屢見諸報(bào)端雜志的食品問題不得不引起我們的重視與思考。2009年2月28日由十一屆全國人大常委會(huì)宣布通過的《中華人民共和國食品安全法》充分表明了人民群眾對于有毒有害食品等問題的深惡痛絕以及對健康安全食品的渴望，也體現(xiàn)了國家對于懲治管理食品安全問題的決心。 本文通過對遼寧省小作坊生產(chǎn)加工食品安全問題現(xiàn)狀的調(diào)查、研究、分析，結(jié)合我省的實(shí)際情況吸收經(jīng)驗(yàn)，形成了一個(gè)小作坊食品監(jiān)督管理的立法整體思路并且在引進(jìn)筆者個(gè)人想法和觀點(diǎn)基礎(chǔ)上構(gòu)思了一個(gè)完整的關(guān)于小作坊食品監(jiān)督管理的立法建議稿，希望以此來呼吁有關(guān)立法機(jī)關(guān)盡快出臺(tái)遼寧省小作坊食品監(jiān)督管理的法律文件來徹底消除遼寧省內(nèi)小作坊的安全隱患。 本文第一章總體論述了小作坊在社會(huì)經(jīng)濟(jì)生活中所處的地位以及在歷史發(fā)展進(jìn)程中發(fā)揮的效力并重點(diǎn)討論了小作坊的定義亦即小作坊成立的標(biāo)準(zhǔn)。 第二章綜合分析了遼寧省小作坊在各方面的特點(diǎn)以及存在哪些不足為遼寧省立法管理小作坊提供實(shí)踐的經(jīng)驗(yàn)依據(jù)。 第三章總結(jié)小作坊管理的目的意義結(jié)合遼寧省小作坊立法的可行性及必要性形成一個(gè)完整的立法背景做出制定管理辦法的立法思路。并且最終形成一個(gè)完整的立法建議稿包含對小作坊的基本要求、監(jiān)督管理細(xì)則和法律后果承擔(dān)等內(nèi)容，及相應(yīng)的做出一定的解釋說明。
[Abstract]:In recent years, with the continuous emergence of various food safety issues, people begin to pay more and more attention to the food safety problems of daily consumption. At the same time, the state has also stepped up its efforts to supervise and regulate food safety issues. The "Sanlu" milk powder incident has caused a nationwide uproar, but this is only the tip of the iceberg. The food problems in newspapers and magazines have to arouse our attention and thinking. The Food Safety Law of the people's Republic of China, announced by the standing Committee of the Eleventh National people's Congress on February 28, 2009, fully shows the masses of the people. People's abhorrence of problems such as toxic and harmful food and their desire for healthy and safe food, It also reflects the determination of the state to punish and manage food safety problems. Based on the investigation, research and analysis of the present situation of the production and processing food safety in small workshops in Liaoning Province, combined with the actual situation of our province, this paper absorbs the experience. Formed a small workshop food supervision and management of the overall thinking of legislation and in the introduction of personal ideas and views on the basis of a complete small workshop food supervision and management of the legislative proposal, I hope to call on the relevant legislative organs to issue as soon as possible the legal documents on the supervision and management of small workshops in Liaoning Province to eliminate the hidden dangers of the safety of small workshops in Liaoning Province. The first chapter of this paper discusses the status of small workshops in the social and economic life and their effectiveness in the process of historical development, and focuses on the definition of small workshops, which is the standard of the establishment of small workshops. The second chapter comprehensively analyzes the characteristics of Liaoning Province small workshops in various aspects and what shortcomings for the legislative management of small workshops in Liaoning Province to provide the empirical basis for the practice. The third chapter summarizes the purpose and significance of small workshop management, combining with the feasibility and necessity of Liaoning province small workshop legislation to form a complete legislative background to develop the legislative thinking of management measures, and finally form a complete. The legislative proposal contains the basic requirements for small workshops. Supervise management rules and legal consequences, etc., and explain them accordingly.
