【摘要】： 應(yīng)對(duì)1910-1911年東北鼠疫災(zāi)難,清政府開展了大規(guī)模的防疫法規(guī)建設(shè),數(shù)量眾多、類型全面、內(nèi)容廣泛的防疫法規(guī)紛紛出臺(tái),中國近代第一部全國性防疫法規(guī)也在此期間誕生。認(rèn)真研究當(dāng)時(shí)的防疫法規(guī)建設(shè),對(duì)今天的防疫立法工作有著非常重大的意義。然而,十分可惜的是,至今無任何文章或著作專門研究該題,本文擬填補(bǔ)此項(xiàng)空白。全文對(duì)這些防疫法規(guī)的數(shù)量、內(nèi)容、特點(diǎn)、作用等進(jìn)行了詳盡的分析,包括以下章節(jié): 緒論。界定防疫法規(guī)的概念,闡述中國近代防疫立法問題的研究現(xiàn)狀,明確本文的寫作目的,說明本文的創(chuàng)新之處。 第一章,東北鼠疫災(zāi)難催生近代防疫法規(guī)。簡述1910-1911年東北鼠疫流行期間防疫法規(guī)的頒布情況,并論述了“中國近代第一部全國性防疫法規(guī)”的誕生及其特點(diǎn)。 第二章,防疫治疫規(guī)程及其實(shí)施。分析具體防疫治疫過程中建立的清潔消毒制度、交通檢疫制度、報(bào)告檢疫制度和醫(yī)療救治制度及其實(shí)施情況,并用大量實(shí)例證明其嚴(yán)格實(shí)施所產(chǎn)生的良好效果。 第三章,防疫輔助規(guī)制及其執(zhí)行。分析獎(jiǎng)懲制度和防疫善后規(guī)定等防疫輔助規(guī)制及其執(zhí)行情況,并用大量實(shí)例證明其有效執(zhí)行所發(fā)揮的積極作用。 第四章,清政府防疫法規(guī)建設(shè)的歷史評(píng)價(jià)。當(dāng)時(shí)的防疫法規(guī),其源流具有泊來性、制定具有應(yīng)急性、執(zhí)行具有強(qiáng)制性和內(nèi)容具有靈活性。大規(guī)模的防疫法規(guī)建設(shè)不僅對(duì)當(dāng)時(shí)的疫情綜合治理、防止鼠疫復(fù)發(fā)起到了重大的現(xiàn)實(shí)作用,而且對(duì)后世的防疫法規(guī)建設(shè)產(chǎn)生了深遠(yuǎn)的歷史影響,更重要的是,給予今人極大的歷史啟示。結(jié)束語。 總之,本文將史學(xué)、衛(wèi)生法學(xué)、預(yù)防醫(yī)學(xué)等學(xué)科的相關(guān)理論作為分析的理論基礎(chǔ),將大量首次披露的檔案資料和官方文獻(xiàn)作為論證的史料基礎(chǔ),力求對(duì)清末防疫法規(guī)這一嶄新課題進(jìn)行較為全面、系統(tǒng)的學(xué)術(shù)探討。
[Abstract]:In response to the plague disaster in northeast China from 1910-1911, the Qing government carried out a large-scale construction of epidemic prevention laws and regulations, which were numerous in number, comprehensive in type, and extensive in content. During this period, the first national epidemic prevention laws and regulations of modern China were born.It is of great significance for today's epidemic prevention legislation to study carefully the construction of epidemic prevention laws and regulations at that time.However, it is a pity that no article or work has been devoted to this subject, and this paper intends to fill the gap.The full text has carried on the detailed analysis to the quantity, the content, the characteristic, the function and so on, including the following chapters:IntroductionThis paper defines the concept of epidemic prevention law, expounds the current research situation of epidemic prevention legislation in modern China, clarifies the writing purpose of this article, and explains the innovation of this paper.The first chapter, the plague disaster in Northeast China gave birth to modern epidemic prevention laws and regulations.This paper briefly describes the promulgation of the laws and regulations on prevention of plague during the epidemic period of 1910-1911 in Northeast China, and discusses the birth and characteristics of the first National epidemic Prevention Law in Modern China.Chapter II, epidemic prevention and treatment procedures and their implementation.The cleaning and disinfection system, traffic quarantine system, reporting quarantine system, medical treatment system and their implementation were analyzed in the course of epidemic prevention and treatment, and a large number of examples were used to prove the good effect of their strict implementation.The third chapter, the epidemic prevention auxiliary regulation and its execution.This paper analyzes the system of reward and punishment and the regulations of preventing epidemic and treating the aftermath and so on, and its implementation, and proves by a large number of examples the positive role it plays in the effective implementation.Chapter IV, the Qing government epidemic prevention laws and regulations of the historical evaluation.At that time, the epidemic prevention laws and regulations had the characteristics of source and flow, emergency, enforcement and flexibility.The large-scale construction of epidemic prevention laws not only played an important practical role in the comprehensive management of the epidemic situation at that time and prevented the recurrence of plague, but also had a profound historical impact on the construction of epidemic prevention laws for later generations, more importantly,It gives us great historical enlightenment.Concluding remarksIn a word, this paper takes the relevant theories of historiography, health law, preventive medicine and other disciplines as the theoretical basis for analysis, and takes a large number of archival materials and official documents first disclosed as the historical basis for the demonstration.This paper tries to make a comprehensive and systematic academic discussion on the new topic of epidemic prevention laws and regulations in the late Qing Dynasty.
