　　隨著全球化進(jìn)程的加快和深入發(fā)展,中國的經(jīng)濟(jì)和文化在過去的三十年中對(duì)全球其他地區(qū)的影響也不斷擴(kuò)大。在國際經(jīng)濟(jì)活動(dòng)中,中國和外國在法律領(lǐng)域的交流在逐步增多。因此,法律文書的翻譯在方便中外交流中貢獻(xiàn)巨大�？梢哉f,經(jīng)濟(jì)活動(dòng)中利益的得與失在很大程度上依賴于相關(guān)法律文書翻譯的正確與否。然而,給出一個(gè)完全令人滿意的翻譯對(duì)法律文書的譯者來說并非易事,因?yàn)榉晌臅g涉及到三個(gè)學(xué)術(shù)領(lǐng)域:法學(xué),語言學(xué)和翻譯學(xué),掌握此三領(lǐng)域難上加難。這就造成法律文書翻譯質(zhì)和量遠(yuǎn)遠(yuǎn)落后于其實(shí)際需求。目前,國內(nèi)外許多翻譯家和法律專業(yè)人士均專注于此領(lǐng)域的研究并提出了很多具有建設(shè)意義的原則和方法。但是如果我們閱讀他們的研究成果就會(huì)發(fā)現(xiàn)兩個(gè)問題:一個(gè)是關(guān)于研究對(duì)象的。過去的研究者們大多集中于在法律文書的微觀層面進(jìn)行研究,如對(duì)法律術(shù)語和法律文書句法的分析和翻譯。在這種情況下,微觀層面的對(duì)等被反復(fù)強(qiáng)調(diào)而文本功能卻被忽視。另一個(gè)問題是關(guān)于建立研究體系的。法律文書翻譯的研究現(xiàn)狀表明目前的研究缺乏體系性。研究者們集中精力于法律文字及如何最大限度的保持其意義,從而忽略了建立一個(gè)包含定義,分類和方法論的完整研究體系。這種不全面的研究角度導(dǎo)致了法律...
