On the Translation of Litigation Documents with Foreign Elem

隨著全球化進程和中國改革開放進程不斷深入,中外法律文化的交流也呈現(xiàn)出蓬勃發(fā)展的態(tài)勢。法律翻譯的重要性和緊迫性不言而喻。訴訟文書,作為一國法律的重要載體,明確了當(dāng)事人的權(quán)利義務(wù)關(guān)系,體現(xiàn)了公正司法、維護社會公平正義的宗旨。當(dāng)前,學(xué)界對涉外訴訟文書翻譯的研究尚未形成專門系統(tǒng)的理論體系,而實踐中涉外訴訟文書的翻譯更是參差不齊,謬誤百出。有專家指出,法律文本翻譯的研究水平遠落后于文學(xué)翻譯和科技翻譯等領(lǐng)域的研究水平。但是值得一提的是,韓禮德提出的系統(tǒng)功能語篇分析為翻譯研究和翻譯實踐提供了強大的理論支持,也為法律翻譯的研究領(lǐng)域開拓了新的局面。筆者擬從語篇分析的視角出發(fā),對涉外訴訟文書的翻譯進行全面系統(tǒng)的研究。首先,對涉外訴訟文書的基本概念加以闡述,介紹涉外訴訟文書翻譯的基本情況,對涉外訴訟文書翻譯中常見的問題和原因進行分析歸納,指出本文研究的現(xiàn)實意義。其二,從語篇的內(nèi)部因素出發(fā),對涉外訴訟文書翻譯過程中的遣詞構(gòu)句、語體特點,篇章結(jié)構(gòu)進行深入探討,以期在語言的表層結(jié)構(gòu)上提高涉外訴訟文書的翻譯質(zhì)量。其三,從語篇的外部因素出發(fā),對產(chǎn)生涉外訴訟文書特有的司法語境、法律體系和社會功能進行研究,并指出在中國特有...
