　　隨著我國社會主義法治文明的不斷完善,人們學(xué)習(xí)法律、利用法律維護自身合法權(quán)益的意識不斷增強。根據(jù)中華人民共和國法律規(guī)定,辯護制度是刑事法律中的一項重要的訴訟制度,而刑事辯護詞則是被告維護自身合法權(quán)益,實現(xiàn)辯護職能最重要的工具之一。法律與語言的關(guān)系密不可分,對刑事辯護詞語言特征的研究,對實現(xiàn)辯護詞的勸說目的有著非常重要的作用。雖然國內(nèi)外對辯護詞的研究已經(jīng)取得了許多顯著的成就,但很少或幾乎沒人從目的原則角度對辯護詞進行法律語言特征的分析。 目的原則是中國語言學(xué)家廖美珍教授于2002年在中國首次系統(tǒng)提出的一種新的語用原則。本文通過對10個精心選取的刑事辯護詞片段的書面語言從目的原則角度展開研究,旨在探索中國刑事辯護詞中語言藝術(shù)性的適用性及其表現(xiàn),以及如何平衡語言規(guī)范性和藝術(shù)性之間的關(guān)系。經(jīng)過全面深入的分析,本文得出以下結(jié)論:第一,語言藝術(shù)性,即個性化,通俗易懂,模糊,情感訴求,生動,在中國刑事辯護詞中是普遍適用的;第二,語言規(guī)范性和語言藝術(shù)性在中國刑事辯護詞中是可以平衡的,其中語言的規(guī)范性是辯護詞的主要特點,語言的藝術(shù)性是辯護語言的次要手段。 此外,由于時間和篇幅的限制,本文還...
