中美法庭判決書的語篇語義對比研究

對不同文化法律語篇本質(zhì)的對比分析和研究不僅有利于跨文化研究,更有利于跨文化法律交流。然而迄今為止,中國的對比研究主要集中于影響英漢兩種語言異同的一般規(guī)則上,鮮有學者關注英漢兩種語言法律語篇的對比分析,而從語篇語義學的角度對法律語篇中的判決書的對比研究更為少見。判決書是法院根據(jù)判決寫成的文書,是法律界常用的一種應用文體。以語篇語義理論為研究依據(jù),從跨文化對比的角度,本研究將對中美判決書進行系統(tǒng)的對比分析和討論,旨在探索中美兩國判決書的異同點,進而挖掘影響兩種語言判決書信息構建與語言實現(xiàn)的因素。在系統(tǒng)研究的基礎上,馬丁和羅斯于2003年較為完整的創(chuàng)建了語篇語義學理論。此理論包括五個子系統(tǒng),亦即分析語篇的五種視角:評價、概念、聯(lián)結、識別和語篇格律。評價即態(tài)度磋商,主要介紹態(tài)度的種類、介入的方法和評價的來源。概念即為經(jīng)驗體現(xiàn),聚焦于語篇的內(nèi)容,即活動的類型以及活動參與者的描述、分類和組成。聯(lián)結主要研究語篇的內(nèi)部邏輯關系—附加、對比、時間、因果等。識別關注的是識別和追蹤文本中的參與者,研究人或物入篇后對讀者的意義。語篇格律研究語篇的信息流,關心語篇組織過程中的信息脈沖是如何整體打包以便于讀者理解...
