【摘要】：當今社會，仲裁是一種與訴訟并行的解決民商事糾紛的重要途徑。盡管許多社會學家和法學家已經(jīng)對仲裁進行了研究，但仲裁的語言學研究卻剛剛起步。裁決書作為仲裁活動中最重要的文本也屬于新興的法律語言學的研究對象，卻并未受到相應的關注，因而從語言學的角度對裁決書進行分析具有非常廣闊的前景和重要的研究價值。一方面，本文結論可以填補國內(nèi)關于中文裁決書語言學研究的空白，對司法語言學研究具有重要的補充作用；另一方面，本文的分析可以為裁決書作者及廣大非專業(yè)讀者提供一定借鑒，對仲裁的普及和發(fā)展具有積極的意義。 體裁分析是ESP研究中的一項重要研究手段，是語言學、社會學和心理學等多種學科交叉活動的產(chǎn)物，將語篇分析從表層描述轉(zhuǎn)向?qū)暧^結構和交際功能的深層解釋。本文以體裁分析為手段，結合語料庫方法對中文仲裁裁決書進行了分析，旨在揭示其體裁特征。首先，本文創(chuàng)建了一個由25篇中文裁決書原文構成的小型語料庫；然后，本文依據(jù)仲裁裁決書的首要功能提出裁決書的交際目的，即明確雙方當事人的權利和義務以解決爭議；接著，基于Swales的語步-步驟理論及仲裁裁決書的交際目的，本文建立了裁決書的語步-步驟模型并對語料進行人工標注；最后，本文通過語料庫統(tǒng)計分析對該模型進行驗證并對各個語步中采用的語篇策略技巧分別進行分析。 通過語料庫分析，本文發(fā)現(xiàn)中文裁決書具有以下特點：第一，國內(nèi)的裁決書具有高度標準化的特征；第二，裁決書總體具有較強的可讀性和可理解性；第三，裁決書的內(nèi)容安排始終圍繞爭議展開，體現(xiàn)了仲裁的高效性；第四，裁決書語言具有非常嚴謹?shù)奶卣饕员苊馇夂驼`讀；第五，裁決書有殖民化的傾向，但也有區(qū)別于訴訟的詞匯特點。這些特點在裁決書交際目的的影響下，，利用各種語篇策略和技巧形成，并且反過來幫助實現(xiàn)裁決書的交際目的。
[Abstract]:Nowadays, arbitration is an important way to solve civil and commercial disputes in parallel with litigation. Although many sociologists and jurists have studied arbitration, the linguistic study of arbitration has just begun. As the most important text in arbitration activities, the award also belongs to the research object of the emerging legal linguistics, but it has not received the corresponding attention. Therefore, the analysis of the award from the perspective of linguistics has a very broad prospect and important research value. On the one hand, the conclusion of this paper can fill the gap in the study of Chinese award linguistics in China, which has an important complementary role to the study of judicial linguistics; On the other hand, the analysis of this paper can provide some reference for the author of the award and the general non-professional readers, and has a positive significance for the popularization and development of arbitration. Genre analysis is an important research tool in the study of ESP. It is the product of interdisciplinary activities in linguistics, sociology and psychology. It changes discourse analysis from superficial description to deep explanation of macro-structure and communicative function. This paper analyzes the Chinese arbitral award by means of genre analysis and corpus method in order to reveal its genre characteristics. Firstly, this paper creates a small corpus composed of 25 original texts of Chinese awards, and then, according to the primary function of the arbitral award, puts forward the communicative purpose of the award, that is, to clarify the rights and obligations of both parties in order to resolve disputes; Then, based on the step-step theory of Swales and the communicative purpose of arbitral award, this paper establishes the step-step model of the award and manually annotates the corpus. Finally, this paper validates the model by corpus statistical analysis and analyzes the discourse strategy skills used in each language step. Through corpus analysis, this paper finds that the Chinese award has the following characteristics: first, the domestic award has the characteristics of highly standardized; second, the award has strong readability and comprehensibility, and the Chinese award has the following characteristics: first, the domestic award has the characteristics of high standardization, second, the award has strong readability and comprehensibility; Third, the content of the award has always been around the dispute, reflecting the high efficiency of arbitration; fourth, the language of the award has very rigorous characteristics to avoid misinterpretation and misreading; Fifth, the award has the tendency of colonization, but also different from the lexical characteristics of litigation. Under the influence of the communicative purpose of the award, these characteristics are formed by using various discourse strategies and techniques, and in turn help to achieve the communicative purpose of the award.
