【摘要】：整理者認為《為獄等狀四種》中"吏議"的主體為縣吏,然縣吏似無權(quán)參與案件的審判,而直接聽命于郡守的都吏是有斷獄和向廷尉奏讞的權(quán)力的,故"吏議"之主體當為都吏。一般認為"邦亡"指逃出國境,然從《癸、瑣相移謀購案》可知秦人逃亡到南郡被定為"邦亡"罪,而案發(fā)時南郡早已劃入秦版圖之中,故知"邦亡"當為逃離秦故地,而非逃離國境。"邦亡"是一定歷史時期內(nèi)秦國特有的稱謂,秦統(tǒng)一后該詞未見于文獻之中。
[Abstract]:The collators thought that the main body of the "officials' discussion" in "prison" was county officials, but the county officials did not seem to have the right to participate in the trial of the case, and the city officials who directly obeyed the county guards had the power to break the prison and to play to the court lieutenant. " "the death of a State" is a special appellation of Qin State in a certain historical period, which was not found in the literature after the unification of Qin Dynasty.
