【摘要】：眾多翻譯界的專家學(xué)者紛紛就法律翻譯發(fā)表學(xué)術(shù)文章和專題著作。大都是圍繞著奈達(dá)的“對等”理論、紐馬克的“交際翻譯”理論和費(fèi)米爾的“功能翻譯”理論展開論述。法律翻譯研究方向受到了束縛。法美學(xué)作為法學(xué)和美學(xué)的交叉學(xué)科，為我們提供了研究法律翻譯的新視角。翻譯理論家劉宓慶在2011年提出了“翻譯的美學(xué)轉(zhuǎn)向”問題引發(fā)了翻譯屆的新一輪討論。而作為權(quán)威性極高的立法文本在美的視域下更具研究價(jià)值。 本文以翻譯美學(xué)為理論基礎(chǔ)，以法美學(xué)為支撐，首先分析了立法文本翻譯美學(xué)研究的可行性即立法文本中美學(xué)價(jià)值的體現(xiàn)。不同于文學(xué)文本和科技文本的，立法文本的美學(xué)價(jià)值主要體現(xiàn)在簡潔，對稱的形式美和準(zhǔn)確、邏輯的內(nèi)容美上。在系統(tǒng)分析立法文本美學(xué)價(jià)值的基礎(chǔ)上，本文結(jié)合實(shí)例著重探討了譯者如何在目標(biāo)語中重現(xiàn)源語立法文本的美，最后采用范疇化研究方法，通過分析立法文本翻譯中美的缺失問題歸納總結(jié)如何在翻譯中發(fā)現(xiàn)和保留美的問題。通過研究本文得出了在立法文本翻譯中如何最大程度的保存美的策略。準(zhǔn)確透徹的理解源語法條的法律約束力即法律實(shí)質(zhì)是立法文本翻譯的前提和基礎(chǔ)，在掌握大前提的基礎(chǔ)下，仔細(xì)掃描源語文本中的“四美”即準(zhǔn)確、邏輯、簡潔和對稱美，最后通過保留法條程式化結(jié)構(gòu)，恰當(dāng)?shù)厥褂梅尚g(shù)語，，合理安排句子結(jié)構(gòu)等具體策略來實(shí)現(xiàn)“高品質(zhì)”的立法文本翻譯。所謂“高品質(zhì)”的翻譯是指讓讀者在獲取有效知識(shí)，開拓視野的同時(shí)，還能從中獲得審美體驗(yàn)的翻譯活動(dòng)。立法文本翻譯乃至整個(gè)翻譯領(lǐng)域都應(yīng)為這個(gè)目標(biāo)而努力。
[Abstract]:Many experts and scholars in the field of translation have published academic articles and monographs on legal translation, mostly around Nida's "equivalence" theory. Newmark's "communicative translation" theory and Fimmel's "functional translation" theory are discussed. The research direction of legal translation is bound. Legal aesthetics is an interdisciplinary subject of law and aesthetics. It provides us with a new perspective on legal translation. In 2011, Liu Miqing, a translation theorist, proposed the Aesthetic turn of Translation. As a highly authoritative legislative text, it is of great value to study it from the perspective of beauty. Based on translation aesthetics and supported by legal aesthetics, this paper first analyzes the feasibility of the study of translation aesthetics in legislative texts, that is, the embodiment of aesthetic value in legislative texts, which is different from literary texts and scientific texts. The aesthetic value of the legislative text is mainly embodied in the beauty of simplicity, symmetry, accuracy and logic, and on the basis of the systematic analysis of the aesthetic value of the legislative text. This paper focuses on how the translator reproduces the beauty of the legislative text of the source language in the target language, and finally adopts a categorization approach. By analyzing the lack of beauty in the translation of legislative texts, this paper sums up and summarizes the problems of how to find and retain beauty in translation. Through the study of this paper, the strategies of how to preserve beauty to the greatest extent in the translation of legislative texts are obtained, and the strategy of preserving beauty in the translation of legislative texts is accurate. A thorough understanding of the legal binding force of the source grammar is the premise and basis for the translation of legislative texts. On the basis of mastering the major premise, we carefully scan the "four beauties" in the source language text, that is, the beauty of accuracy, logic, simplicity and symmetry. Finally, by retaining the stylized structure of the method, we can use the legal terms appropriately. Reasonable arrangement of sentence structure and other specific strategies to achieve "high-quality" translation of legislative texts. The so-called "high-quality" translation means that readers can acquire effective knowledge and broaden their horizons at the same time. Translation activities from which aesthetic experience can also be gained. The translation of legislative texts and even the whole field of translation should work towards this goal.
