【摘要】：從廣義上說,藝術(shù)挪用是一種傳統(tǒng)教學(xué)方法和創(chuàng)作手法,與挪用相關(guān)的臨摹、模仿、借用等一直被鼓勵(lì)和贊譽(yù),甚至被傳為美談。隨著現(xiàn)代主義的興起,藝術(shù)市場的繁榮,法制建設(shè)的進(jìn)步和維權(quán)意識(shí)的增強(qiáng),一方面,藝術(shù)挪用遇到了侵權(quán)、道德倫理等新情況,法律糾紛不斷;另一方面,挪用藝術(shù)大行其道,深受歡迎,一些挪用藝術(shù)甚至成為藝術(shù)經(jīng)典。可見,在對(duì)待挪用藝術(shù)這個(gè)問題上,現(xiàn)代社會(huì)仍然有分歧,要么站在藝術(shù)界的角度,要么站在法律界的角度,從而使得挪用藝術(shù)面臨困境,很難形成統(tǒng)一的認(rèn)識(shí)并從根本上解決問題。為了促進(jìn)挪用藝術(shù)的發(fā)展,必須進(jìn)一步界定原創(chuàng)性,根據(jù)挪用藝術(shù)的不同情形做出具體的規(guī)定,一方面,預(yù)防抄襲、剽竊等侵犯知識(shí)產(chǎn)權(quán)的違法事件;另一方面,鼓勵(lì)和保護(hù)真正的藝術(shù)創(chuàng)新。藝術(shù)作品具有與一般著作不同的屬性和特點(diǎn)。從長遠(yuǎn)看,有必要制定一部符合藝術(shù)創(chuàng)作規(guī)律的《藝術(shù)法》,并培養(yǎng)跨學(xué)科人才。
[Abstract]:In a broad sense, art misappropriation is a traditional teaching method and creative technique. Copying, imitation and borrowing related to misappropriation have always been encouraged and praised, and even passed on as a good talk. With the rise of modernism, the art market flourished. With the progress of legal system construction and the enhancement of awareness of rights protection, on the one hand, art misappropriation has encountered new situations such as infringement, moral ethics, and so on, and legal disputes continue; on the other hand, misappropriation of art is popular and popular. Some misappropriated art even become art classics. It can be seen that there are still differences in modern society on the issue of misappropriation of art, either from the perspective of the art community or from the perspective of the legal profession, thus making the misappropriation of art face difficulties. It is difficult to form a unified understanding and fundamentally solve the problem. In order to promote the development of misappropriated art, we must further define originality and make specific provisions according to the different circumstances of misappropriating art. On the one hand, we should prevent plagiarism. Plagiarism and other violations of intellectual property rights; on the other hand, to encourage and protect genuine artistic innovation. Works of art have different attributes and characteristics from general works. In the long run, It is necessary to formulate an art law that conforms to the law of artistic creation and to train interdisciplinary talents.
