【摘要】：地下洞穴作為一類特殊的地質(zhì)遺跡資源,是一種非常重要的自然資源。我國的地下洞穴資源含量豐富,并且地下洞穴具有獨(dú)特地質(zhì)和環(huán)境特性,因此,地下洞穴擁有極大的研究意義和觀賞價值,是我國重要的空間資源類型。正是因?yàn)榈叵露囱ǖ囊饬x重大,所以,我們對于地下洞穴的開發(fā)及利用則需要更為謹(jǐn)慎。然而由于我國對于地下洞穴的開發(fā)利用時間較晚,因此,我國地下洞穴的開發(fā)及管理現(xiàn)狀并不樂觀,存在著政府保護(hù)力度不足、民眾保護(hù)意識不強(qiáng)等問題。因此,本文的研究目的在于,通過分析地下洞穴的立法和保護(hù)現(xiàn)狀,找出立法和制度中存在的問題,探索完善我國的地下洞穴立法的具體措施。具體而言,本文在內(nèi)容上主要包括前言(概述)、正文、結(jié)論三部分,其中,正文部分的主要內(nèi)容如下:第一部分為綜述。首先,簡要介紹本文的研究背景、研究目的和意義;其次,對國內(nèi)外的現(xiàn)行立法進(jìn)行簡要的闡釋和說明;最后,說明研究方法與創(chuàng)新點(diǎn)。第二部分為地下洞穴概述。首先,介紹和地下洞穴有關(guān)的概念及其特征;其次,分析地下洞穴的法律屬性及分類;最后,探討地下洞穴與土地所有權(quán)的關(guān)系。第三部分為國外立法現(xiàn)狀和經(jīng)驗(yàn)借鑒。主要介紹兩大法系關(guān)于地下洞穴的相關(guān)立法規(guī)定,著重研究地下洞穴的開發(fā)、保護(hù)及管理模式,并在此基礎(chǔ)上對兩大法系進(jìn)行對比研究,分析國外立法的優(yōu)勢,進(jìn)而探討國外先進(jìn)經(jīng)驗(yàn)對我國的啟示。第四部分為我國地下洞穴立法和實(shí)施現(xiàn)狀。收集我國地下洞穴的相關(guān)資料并予以分析,從理論和實(shí)踐兩方面探討我國地下洞穴在立法和實(shí)施上存在的問題。第五部分為我國地下洞穴開發(fā)及管理體系的完善。本文將分別從完善立法體系、規(guī)范管理制度、提高公眾意識、加大國家投入力度等幾個方面,探討我國地下洞穴相關(guān)立法和制度的具體完善措施。通過完善我國地下洞穴的立法,進(jìn)而完善我國地下洞穴開發(fā)及管理制度,在保證資源多樣性和穩(wěn)定性的前提下,充分發(fā)揮出地下洞穴所獨(dú)有的觀賞及使用價值,即保護(hù)了環(huán)境,又能滿足人類需求,這同時也是可持續(xù)發(fā)展戰(zhàn)略的具體體現(xiàn)。
[Abstract]:As a special kind of geological remains, underground cave is a very important natural resource. The underground cave in China is rich in resources and has unique geological and environmental characteristics. Underground caves have great research significance and ornamental value, which is an important type of space resources in China. It is precisely because of the significance of underground caves, so, We need to be more cautious about the development and utilization of underground caves. However, due to the late development and utilization of underground caves in China, the present situation of development and management of underground caves in China is not optimistic. Therefore, the purpose of this paper is to find out the problems existing in legislation and system by analyzing the legislation and protection status of underground caves. To explore the specific measures to improve the legislation of underground caves in China. Specifically, the content of this paper mainly includes three parts: introduction, text and conclusion. The main contents of the text are as follows: the first part is a summary. The research background, purpose and significance of this paper are briefly introduced. Secondly, the current legislation at home and abroad is briefly explained and explained. Finally, the research methods and innovations are explained. The second part is an overview of underground caves. The concept and characteristics of underground cave are introduced. Secondly, the legal attributes and classification of underground cave are analyzed. Finally, The third part is the current situation and experience of foreign legislation. It mainly introduces the relevant legislative provisions of the two major legal systems on underground caves, focusing on the development, protection and management of underground caves. And on this basis, the comparative study of the two legal systems, analysis of the advantages of foreign legislation, Then the enlightenment of foreign advanced experience to our country is discussed. The 4th part is about the present situation of legislation and implementation of underground cave in China. The relevant data of underground cave in our country are collected and analyzed. This paper discusses the problems existing in the legislation and practice of underground caves in China from the aspects of theory and practice. The 5th part is the perfection of the development and management system of underground caves in China. In order to improve the public consciousness and increase the national investment, this paper probes into the specific measures to improve the legislation and system of underground cave in China. By perfecting the legislation of underground cave in our country, the development and management system of underground cave in China is further improved. On the premise of ensuring the diversity and stability of resources, the unique ornamental and use value of underground caves is brought into full play, that is, the environment is protected and the human needs can be satisfied, which is also the concrete embodiment of the strategy of sustainable development.
