法律語(yǔ)言是體現(xiàn)法律意志、實(shí)現(xiàn)和維護(hù)社會(huì)公平正義的重要手段。廣義上它包括立法的書面語(yǔ)言及司法的動(dòng)態(tài)口語(yǔ)。作為法律語(yǔ)言學(xué)研究的一個(gè)重要分支,庭審話語(yǔ)呈現(xiàn)了法庭審判活動(dòng)中語(yǔ)言互動(dòng)的動(dòng)態(tài)過(guò)程,在其語(yǔ)言特征及語(yǔ)用功能方面都具有相對(duì)的獨(dú)特性。在庭審過(guò)程中,參與者會(huì)采用各種各樣的語(yǔ)言策略進(jìn)行交際,以實(shí)現(xiàn)其各自的交際目的,而轉(zhuǎn)述話語(yǔ)就是其中之一。本文旨在探索庭審語(yǔ)篇中轉(zhuǎn)述話語(yǔ)的語(yǔ)言特征及語(yǔ)用功能。采用定量分析與定性分析相結(jié)合的研究方法,結(jié)合了維索爾倫的語(yǔ)言順應(yīng)論及廖美珍的目的論,提出了一個(gè)更適用于分析庭審轉(zhuǎn)述話語(yǔ)的語(yǔ)言特征及語(yǔ)用功能的分析框架。具體而言,本文致力于,首先,分析轉(zhuǎn)述話語(yǔ)在庭審語(yǔ)篇中的整體使用情況;其次,從轉(zhuǎn)述視角、轉(zhuǎn)述信息及轉(zhuǎn)述態(tài)度三個(gè)角度來(lái)研究庭審轉(zhuǎn)述話語(yǔ)的語(yǔ)言特征,闡釋庭審活動(dòng)中的語(yǔ)言使用者是如何在這三個(gè)方面做出語(yǔ)言選擇以順應(yīng)庭審交際語(yǔ)境的。最后,探討庭審轉(zhuǎn)述話語(yǔ)在順應(yīng)交際語(yǔ)境后所實(shí)現(xiàn)的語(yǔ)用功能。為了解決這些問(wèn)題,筆者選取了20場(chǎng)真實(shí)的刑事庭審案件作為語(yǔ)料,并在其中提取575個(gè)轉(zhuǎn)述話語(yǔ)。通過(guò)分析,筆者發(fā)現(xiàn),第一,整體上轉(zhuǎn)述話語(yǔ)在庭審語(yǔ)篇中有較高的使用頻率,集中使用于法庭調(diào)查和法庭辯論...
