【摘要】：判例匯編在英美法系國家中扮演著重要的角色，對其法律體制具有重要的參考價值。判例匯編由于其技術(shù)性的本質(zhì)，一般來說具有行為性和信息性，同時也具有規(guī)定性，由于其以固定的格式、準(zhǔn)確的措辭書寫，冗長而且乏味。 本文作者旨在基于韓禮德的系統(tǒng)功能理論分析判例匯編中的語法隱喻使用情況，探究判例匯編中的語法隱喻的功能。文章在綜合闡述隱喻和語法隱喻研究的基本情況后，分析了系統(tǒng)功能語法和判例匯編，闡述了法律語言的本質(zhì)，其詞匯、句法、語法特征，以此糾正人們對于法律語言神秘而不可捉摸的誤解，同時論文作者試圖揭示出判例匯編中語法隱喻的三種元功能，例證了判例匯編中概念隱喻、人際隱喻和語篇隱喻的存在，并證明了語法隱喻是判例匯編常采用的有效手段，，并進一步指出，判例匯編中的概念語法隱喻使行文簡潔緊湊，人際語法隱喻使語言客觀、權(quán)威、正式，語篇語法隱喻使得語篇更銜接連貫。 作者希望能夠為今后此領(lǐng)域的研究有所貢獻。由于涉及判例匯編中語法隱喻的研究尚少，希望作者的研究能起到拋磚引玉的作用。
[Abstract]:Case compilation plays an important role in Anglo-American legal system and has important reference value to its legal system. Due to its technical nature, the compilation is generally behavioral and informative, and also prescriptive, as it is written in a fixed format, in accurate wording, long and tedious. Based on Halliday's systematic functional theory, the author aims to analyze the use of grammatical metaphors in the case book and to explore the functions of grammatical metaphors in the case book. After a comprehensive description of the basic situation of the study of metaphor and grammatical metaphor, this paper analyzes the systematic functional grammar and the compilation of jurisprudence, and expounds the essence of legal language, its lexical, syntactic and grammatical characteristics. In order to correct the mysterious and inscrutable misunderstanding of legal language, the author attempts to reveal the three metafunctions of grammatical metaphor in the case book, which exemplifies the existence of conceptual metaphor, interpersonal metaphor and textual metaphor in the case book. It also proves that grammatical metaphor is an effective means used in the compilation of jurisprudence, and further points out that conceptual grammatical metaphor makes the writing concise and compact, and interpersonal grammatical metaphor makes the language objective, authoritative and formal. Grammatical metaphor makes the text more cohesive and coherent. The author hopes to contribute to the future research in this field. Since there are few researches on grammatical metaphors in the case book, it is hoped that the author's research will serve as a starting point.
