【摘要】：電影《秋菊打官司》曾引發(fā)"法治特殊論"與"法治普遍論"之爭,電影《我不是潘金蓮》有助于重新審視這場爭論。對女主角"李雪蓮"兩項(xiàng)訴求的分析表明,現(xiàn)代法治在特定事務(wù)上"無能為力"的表象,是刻意"有所不為"的結(jié)果,目的在于"有所作為",同時(shí)要求"不可亂為"。通過不介入某些實(shí)質(zhì)問題、拒絕做出人格判斷等自我限制,法治得以在高度復(fù)雜的現(xiàn)代社會(huì)中,執(zhí)行穩(wěn)定行為預(yù)期的重要功能。迫使法律進(jìn)行不適當(dāng)?shù)膶?shí)質(zhì)考量,引入"合法/非法"之外的第三種價(jià)值,不會(huì)讓法治更加完善,只會(huì)損害法治本身。另外,"法律與文學(xué)"研究面向戲劇化的文本,可能錯(cuò)失典型的人和事,存在先天局限。
[Abstract]:The film Qiuju Litigation has led to the controversy between "the special theory of rule of law" and "the universal theory of rule of law". The film "I am not Pan Jinlian" helps to re-examine the debate. An analysis of the heroine's two appeals to "Li Xuelian" shows that the modern rule of law is "powerless" in certain matters. It is the result of deliberate "something not to do", the purpose is to "do something", at the same time to ask "not to do anything". By not intervening in some substantive issues, refusing to make personality judgment and other self-restriction. In a highly complex modern society, the rule of law enables it to perform an important function of expected stabilization... It forces the law to carry out inappropriate substantive considerations and introduce a third value beyond "legality / illegality". It will not perfect the rule of law, it will only damage the rule of law itself. In addition, the text of the study of law and literature oriented to drama may miss out on typical people and events, and there are inherent limitations.
