【摘要】：合同、法律文書與法律著作等法律文本的翻譯目前處于較快的發(fā)展階段,但法律學(xué)術(shù)論文的翻譯尚未引起翻譯界的足夠重視。本文在對法律學(xué)術(shù)論文Definite and Substantive Reliance(確定與確實的信賴)的翻譯基礎(chǔ)上,深入剖析了英文法律學(xué)術(shù)論文中頻繁出現(xiàn)的that從句、分詞結(jié)構(gòu)和被動句等相對復(fù)雜的法律長難句式,進而提出法律學(xué)術(shù)論文漢譯時應(yīng)遵循一致性和簡明性原則,并提出可運用破句重組法、斷句拆分法、增補刪減法、重心轉(zhuǎn)移法和被動轉(zhuǎn)正法等翻譯策略指導(dǎo)法律翻譯實踐活動。希望能夠通過本報告的實踐與分析,對未來我國法律學(xué)術(shù)論文的漢譯提供可資借鑒的方法與策略。
[Abstract]:The translation of legal texts, such as contracts, legal documents and legal works, is at a relatively rapid stage of development at present, but the translation of legal academic papers has not attracted enough attention in the field of translation. On the basis of the translation of Definite and Substantive Reliance (, a legal academic paper, this paper analyzes in depth the relatively complex legal long and difficult sentences, such as that clauses, participle structures and passive sentences, which frequently appear in English legal academic papers. Furthermore, the author points out that the principles of consistency and conciseness should be followed in the translation of legal academic papers, and puts forward that some translation strategies, such as sentence reorganization, break-up, supplemental deletion, gravity shift and passive transformation, can be used to guide the practice of legal translation. It is hoped that through the practice and analysis of this report, it can provide some useful methods and strategies for the translation of Chinese legal academic papers in the future.
