【摘要】：弗蘭茲·卡夫卡(Franz Kafka,1883-1924)是二十世紀(jì)西方現(xiàn)代主義文學(xué)的先驅(qū)巨匠,《審判》則為卡夫卡最為經(jīng)典的長(zhǎng)篇小說之一,飽含諸多法律思想、理念。本文透過法律與文學(xué)的視角,不僅是為了探討作品中所呈現(xiàn)出來的法學(xué)問題,更多的是經(jīng)由文學(xué)評(píng)論所揭示的法律與社會(huì)。通過卡夫卡的作品,探索他的法律觀以及基于這種法律觀而反映出的世界觀。本文由四部分組成,提煉出小說中三個(gè)相關(guān)的法律視角,并在后文具體章節(jié)中逐一展開。文章的第一部分包含緒論和第二章,介紹小說的背景和基本情況。從作品的寫作背景出發(fā),聯(lián)系法律與文學(xué)運(yùn)動(dòng),展示本文三個(gè)主要法律問題之間的邏輯關(guān)系。第二部分(第三章)探討程序正義這一問題。首先探討小說中程序正義理念所反映出的現(xiàn)實(shí)狀況,然后對(duì)該理念進(jìn)行系統(tǒng)性梳理,發(fā)現(xiàn)其價(jià)值,為我國(guó)程序正義體制構(gòu)建提供比較和參照。本文的第三部分(第四章)首先提出了法律能否被信仰這一命題,接著對(duì)信仰和法律信仰作了哲學(xué)解釋和法學(xué)解釋,并給出了結(jié)論。面臨中國(guó)當(dāng)下法律信仰普遍缺失的現(xiàn)狀,為我國(guó)法律信仰制度的培育提供意見與建議。本文的第五章著重闡述法律異化。通過研究奧匈帝國(guó)當(dāng)時(shí)存在的法律異化現(xiàn)象,探討法律異化產(chǎn)生的破壞力以及原因,最后提出了應(yīng)當(dāng)從法律異化向人本回歸的現(xiàn)實(shí)路徑。本文認(rèn)為,透過文學(xué)看法律,不應(yīng)當(dāng)局限于看到法律的外在形式規(guī)范,更多的是看到其背后延伸出來的價(jià)值蘊(yùn)涵。百年前歐洲社會(huì)存在的問題,對(duì)當(dāng)今中國(guó)的法治化建設(shè)仍有借鑒及啟示意義,而這都在卡夫卡的作品中有所呈現(xiàn)。
[Abstract]:Franz Kafkaen (1883-1924) is a pioneer of western modernist literature in the 20th century. Trial is one of Kafka's most classic novels, which contains many legal thoughts and ideas.From the perspective of law and literature, this paper aims not only to explore the legal problems in the works, but also to reveal the law and society through literary criticism.Through Kafka's works, the author explores his view of law and the world outlook reflected by his view of law.This paper is composed of four parts, abstracts three relevant legal perspectives in the novel, and unfolds them one by one in the following chapters.The first part of the article includes the introduction and the second chapter, introduces the background and basic situation of the novel.Based on the writing background of the works, this paper demonstrates the logical relationship between the three main legal issues in this paper, in relation to the movement of law and literature.The second part (Chapter three) discusses the problem of procedural justice.This paper first discusses the realistic situation reflected by the concept of procedural justice in the novel, then systematically combs the concept, finds its value, and provides a comparison and reference for the construction of the system of procedural justice in our country.In the third part of this paper (Chapter 4), the proposition of whether the law can be believed is put forward, and then the philosophical and legal interpretations of belief and legal belief are given, and the conclusion is given.In the face of the general lack of legal belief in China at present, advice and suggestions are provided for the cultivation of legal belief system in China.The fifth chapter focuses on legal alienation.By studying the phenomenon of legal alienation in Austro-Hungarian Empire at that time, this paper discusses the destructive power and causes of legal alienation, and finally puts forward the realistic path from legal alienation to humanism.In this paper, we should not only look at the external formal norms of law, but also see the value implication behind it.The problems existing in European society a hundred years ago still have reference and enlightenment to the construction of the rule of law in China today, which are all presented in Kafka's works.
