【摘要】：眾所周知,我國(guó)每年都有許多的缺陷嬰兒出生,在醫(yī)學(xué)實(shí)踐不斷發(fā)展的今天,有許多缺陷新生兒能夠得到康復(fù),也有許多的法律條文保護(hù)這一類(lèi)生命,但是,對(duì)嚴(yán)重缺陷新生兒的倫理討論從未停止,他們的臨床治療問(wèn)題一直受到各界的關(guān)注。義務(wù)論與生命神圣論一直堅(jiān)持所有的生命都應(yīng)該被尊重,任何生命都不應(yīng)該被放棄,不管缺陷有多嚴(yán)重都應(yīng)該受到醫(yī)學(xué)治療,而以功利主義為理論基礎(chǔ)的生命質(zhì)量論、生命價(jià)值論等,主張要對(duì)生命產(chǎn)生的功利進(jìn)行計(jì)算,從而允許放棄某些生命的治療。本文將對(duì)支持治療和撤銷(xiāo)治療的各種理論進(jìn)行分析,指出各自的理論缺陷,并明確放棄某些嚴(yán)重缺陷生命的治療是更符合醫(yī)療現(xiàn)實(shí)的。在此基礎(chǔ)上,本文將圍繞根據(jù)什么標(biāo)準(zhǔn)放棄嚴(yán)重缺陷新生兒的生命治療進(jìn)行深入討論,通過(guò)審視目前流行的標(biāo)準(zhǔn),嘗試提出一個(gè)更符合倫理要求、更具臨床操作性的標(biāo)準(zhǔn)。
[Abstract]:As we all know, there are many babies born with defects every year in our country. Today, with the development of medical practice, many newborns with defects can be rehabilitated, and there are many legal provisions to protect this kind of life, however. The ethical discussion of severely defective newborns has never stopped, and their clinical treatment has been concerned by all circles. The theory of obligation and the sacredness of life have always insisted that all life should be respected. Any life should not be given up, no matter how serious the defects should be medical treatment, and utilitarian theory of quality of life, life value theory and so on. It is advocated to calculate the utility of life so as to permit the abandonment of the treatment of certain life. This paper will analyze the various theories supporting treatment and revocation therapy, and point out their respective theoretical defects. It is more in line with the medical reality to give up the treatment of some seriously defective life. On this basis, this paper will discuss in depth the criteria according to which to give up the life treatment of severely defective newborns. By reviewing the current popular standards, we try to propose a more ethical and clinical operational standard.
