本文研究了緬甸知識(shí)產(chǎn)權(quán)執(zhí)法的法律和制度框架。實(shí)施知識(shí)產(chǎn)權(quán)包括兩個(gè)因素。一是制定和頒布法律。第二個(gè)因素是執(zhí)行法律規(guī)定,包括由法院解釋法律和確定案件、調(diào)查侵犯知識(shí)產(chǎn)權(quán)的行為、防止未經(jīng)授權(quán)地利用權(quán)利以及使用法律規(guī)定的制裁和補(bǔ)救措施。本文還考察了緬甸目前的知識(shí)產(chǎn)權(quán)法律框架及其執(zhí)行情況和新的知識(shí)產(chǎn)權(quán)法律體系（商標(biāo)法、著作權(quán)法草案、工業(yè)設(shè)計(jì)法）。本文的主要目的是探討緬甸知識(shí)產(chǎn)權(quán)執(zhí)法現(xiàn)狀,找出現(xiàn)行知識(shí)產(chǎn)權(quán)執(zhí)法法律制度框架的不足之處。針對(duì)知識(shí)產(chǎn)權(quán)法律制度的現(xiàn)狀,本文認(rèn)為緬甸需要發(fā)展知識(shí)產(chǎn)權(quán)法律制度,實(shí)施有效透明的知識(shí)產(chǎn)權(quán)法律,加強(qiáng)執(zhí)法,培養(yǎng)知識(shí)產(chǎn)權(quán)實(shí)務(wù)人才,發(fā)展知識(shí)產(chǎn)權(quán)相關(guān)法律。最后,本文對(duì)緬甸知識(shí)產(chǎn)權(quán)有效實(shí)施的必要性框架進(jìn)行了研究,并提出了建議。
