本文研究了緬甸知識產(chǎn)權執(zhí)法的法律和制度框架。實施知識產(chǎn)權包括兩個因素。一是制定和頒布法律。第二個因素是執(zhí)行法律規(guī)定,包括由法院解釋法律和確定案件、調查侵犯知識產(chǎn)權的行為、防止未經(jīng)授權地利用權利以及使用法律規(guī)定的制裁和補救措施。本文還考察了緬甸目前的知識產(chǎn)權法律框架及其執(zhí)行情況和新的知識產(chǎn)權法律體系（商標法、著作權法草案、工業(yè)設計法）。本文的主要目的是探討緬甸知識產(chǎn)權執(zhí)法現(xiàn)狀,找出現(xiàn)行知識產(chǎn)權執(zhí)法法律制度框架的不足之處。針對知識產(chǎn)權法律制度的現(xiàn)狀,本文認為緬甸需要發(fā)展知識產(chǎn)權法律制度,實施有效透明的知識產(chǎn)權法律,加強執(zhí)法,培養(yǎng)知識產(chǎn)權實務人才,發(fā)展知識產(chǎn)權相關法律。最后,本文對緬甸知識產(chǎn)權有效實施的必要性框架進行了研究,并提出了建議。
