【摘要】：社會主義法治是實現(xiàn)社會穩(wěn)定、國家長治久安的客觀要求。依法治招是我國法治社會建設的必然要求,也是依法治教,確保教育公平公正的必然要求。普通高校招生承載著廣大考生實現(xiàn)大學的夢想,充滿著家長和社會對未來的希冀,寄托著人們對于招生公平公正的追求,如何推進招生法治化的進程,構(gòu)建規(guī)則公平、過程公開、結(jié)果公正的高校招生制度,維護招生主體的合法權(quán)益,是考試招生制度改革的急迫要求,是實現(xiàn)人才強國戰(zhàn)略的有力保障。本文從五個方面研究了中國普通高校招生法治化問題。第一個方面緒論。研究普通高校招生法治化的背景,包括戰(zhàn)略背景、法律背景、改革背景、政策背景、現(xiàn)實背景和防控背景,同時研究了普通高校招生法治化的意義。從普通高校招生法治化內(nèi)涵、原則和意義,高校招生計劃管理和分配等七個方面進行了國內(nèi)研究綜述；并從高校招生組織體系、招生考試科目和內(nèi)容、招生考試形式、招生錄取標準等方面進行了國外高校招生制度及法治化的研究綜述。第二個方面中國普通高校招生法治化的理論基礎與歷史沿革。論述了中國普通高校招生法治化的概念,并分析了馬克思主義法治理論、平等理論、權(quán)利理論和依法治國理論等理論基礎�；仡櫡治隽宋覈胀ǜ咝Ｕ猩贫燃胺ㄖ位臍v史沿革。第三個方面中國普通高校招生法治化的現(xiàn)狀。從普通高校招生法治理念、法治文化、法治化實施過程方面分析了我國普通高校招生法治化的成就、存在的問題和原因。第四個方面國外高校招生制度及法治化的特征與啟示。選擇美國、英國、日本、俄羅斯進行普通高校招生制度及法治化的特征分析和與我國的對比研究,思考和提出對我國普通高校招生法治化的啟示。第五個方面完善中國普通高校招生法治化的思路。提出確立普通高校招生法治理念,構(gòu)建普通高校招生法治文化,明晰普通高校招生法律關(guān)系,完善普通高校招生法治化的路徑。就完善路徑提出普通高校招生計劃編制的法治化、考試科目及內(nèi)容設置的法治化、考試方式的法治化、錄取方式的法治化、管理程序制度的法治化、權(quán)利救濟的法治化等六個對策。
[Abstract]:The socialist rule of law is an objective requirement for achieving social stability and lasting national stability. The rule of law is an inevitable requirement for the construction of a society ruled by law, as well as an inevitable requirement for administering education according to law and ensuring the fairness and fairness of education. College enrollment carries the students' dream of realizing the university, full of parents' and society's hope for the future, the people's pursuit of fair and just enrollment, how to promote the process of legalization of enrollment, and how to construct the rules of fairness. The open process and fair result of the enrollment system in colleges and universities, maintaining the legitimate rights and interests of the main body of enrollment, are the urgent requirements of the reform of the examination enrollment system, and are the powerful guarantee for the realization of the strategy of strengthening the country by talents. This paper studies the legalization of enrollment in Chinese colleges and universities from five aspects. Introduction to the first aspect. This paper studies the background of the legalization of college enrollment, including the strategic background, the legal background, the reform background, the policy background, the realistic background and the prevention and control background. At the same time, it studies the significance of the legalization of college enrollment. This paper summarizes the domestic research from seven aspects, including the connotation, principle and significance, the management and distribution of college enrollment plan, and the system of enrollment organization, the subjects and contents of enrollment examination, the form of enrollment examination, etc. This paper summarizes the research on enrollment system and rule of law in foreign universities. The second aspect is the theoretical basis and historical evolution of the legalization of college enrollment in China. This paper discusses the concept of legalization of enrollment in Chinese colleges and universities, and analyzes the theoretical basis of Marxist theory of rule of law, theory of equality, theory of right and theory of governing the country by law. This paper reviews and analyzes the history of enrollment system and rule of law in colleges and universities in China. The third aspect is the current situation of the legalization of enrollment in Chinese colleges and universities. This paper analyzes the achievements, problems and reasons of the legalization of enrollment in colleges and universities in China from the aspects of the idea of rule by law, the culture of rule of law and the process of implementing the rule of law. The fourth aspect is the characteristics and enlightenment of the enrollment system and the rule of law in foreign colleges and universities. This paper chooses the United States, Britain, Japan and Russia to analyze the characteristics of the enrollment system and legalization of ordinary colleges and universities, and makes a comparative study with our country, and puts forward the enlightenment to the legalization of the enrollment of ordinary colleges and universities in our country. The fifth aspect consummates the thought of the rule of law of the enrollment of Chinese general colleges and universities. This paper puts forward the idea of establishing the rule of law of enrollment in ordinary colleges and universities, constructing the culture of the rule of law of enrollment in colleges and universities, clarifying the legal relationship of enrollment in colleges and universities, and perfecting the path of legalization of enrollment in colleges and In order to perfect the path, the author puts forward the rule of law, the rule of law of the course and content of the examination, the rule of law of the examination mode, the rule of law of the admission method, and the rule of law of the management procedure system.
