當(dāng)代大學(xué)生法治觀念培育研究

【摘要】:法治,是人類社會(huì)的文明指針、是各民族共同的價(jià)值追求,是當(dāng)代中國(guó)篤行的社會(huì)理想。法律的權(quán)威源自人民的內(nèi)心擁護(hù)和真誠(chéng)信仰,在當(dāng)代中國(guó)的法治實(shí)踐中,公民的法治觀念起著先行作用,是法治中國(guó)理想能否實(shí)現(xiàn)的關(guān)鍵。當(dāng)代大學(xué)生法治觀念培育不僅是我國(guó)公民法治觀念培育體系的重要組成部分,也是我國(guó)現(xiàn)代高等教育的重要內(nèi)容之一。本文以馬克思主義理論為指導(dǎo),以思想政治教育視角切入當(dāng)代大學(xué)生社會(huì)主義法治觀念培育問(wèn)題,運(yùn)用文獻(xiàn)分析、定性分析、系統(tǒng)分析、社會(huì)調(diào)查等方法,既立足于現(xiàn)實(shí),又梳理歷史;既注重理論研究,又落腳于教育實(shí)踐;既強(qiáng)調(diào)教育要素的創(chuàng)新,又重視長(zhǎng)效機(jī)制的建立。整個(gè)論文的核心主旨在于破解“如何正確理解當(dāng)代大學(xué)生法治觀念培育”這一問(wèn)題,并構(gòu)建當(dāng)代大學(xué)生法治觀念培育的長(zhǎng)效機(jī)制。本文共分為緒論、正文和結(jié)語(yǔ)三大部分,其中正文部分共六章,遵循“認(rèn)清時(shí)代需要——梳理歷史脈絡(luò)——明晰現(xiàn)實(shí)問(wèn)題——探究機(jī)制策略”的基本邏輯來(lái)建構(gòu)。第一章對(duì)當(dāng)代大學(xué)生法治觀念的時(shí)代背景進(jìn)行了深度解讀。法治是當(dāng)代中國(guó)改革和發(fā)展的最強(qiáng)音,在“四個(gè)全面”戰(zhàn)略布局中擔(dān)當(dāng)著有力支撐,是“兩個(gè)百年”奮斗目標(biāo)和中華民族偉大復(fù)興夢(mèng)的重要保障。當(dāng)代大學(xué)生法治觀念培育作為我國(guó)全面推進(jìn)依法治國(guó)中的基礎(chǔ)性環(huán)節(jié),應(yīng)符合當(dāng)代中國(guó)法治新制度、新輿論、新實(shí)踐的要求,符合高等教育“立德樹(shù)人”的新期待。從現(xiàn)實(shí)回到歷史,本文第二章研究了改革開(kāi)放以來(lái)我國(guó)大學(xué)生法治觀念培育的歷史經(jīng)驗(yàn),以七次全民普法規(guī)劃和高校對(duì)大學(xué)生法治觀念培育的回應(yīng)為脈絡(luò),將改革開(kāi)放以來(lái)我國(guó)大學(xué)生法治觀念培育的進(jìn)程分為了四個(gè)階段。并總結(jié)出了對(duì)當(dāng)代大學(xué)生法治觀念培育有啟示意義的具體經(jīng)驗(yàn):發(fā)揮法律基礎(chǔ)課程在大學(xué)生法治觀念培育中的核心作用;注重校園文化建設(shè)對(duì)大學(xué)生法治觀念培育的積極影響;以依法治校推動(dòng)大學(xué)生法治觀念的樹(shù)立;始終堅(jiān)持法治觀念培育與德育的緊密結(jié)合;及重視大學(xué)生法治觀念培育的規(guī)范化、制度化建設(shè)。以問(wèn)題為導(dǎo)向,本文第三章分析了當(dāng)代大學(xué)生法治觀念的現(xiàn)狀、當(dāng)代大學(xué)生法治觀念培育的現(xiàn)狀及當(dāng)前大學(xué)生法治觀念培育面臨的多維困境。通過(guò)對(duì)大學(xué)生法治認(rèn)知、法治評(píng)價(jià)、法治情感和法治行為的社會(huì)調(diào)查,揭示出當(dāng)代大學(xué)生法治觀念現(xiàn)狀還不樂(lè)觀。同時(shí),詳細(xì)考察了當(dāng)前高校在大學(xué)生法治觀念培育方面的具體做法,闡述了其在法治觀念培育課程體系、《法律基礎(chǔ)》課教學(xué)、法治教育實(shí)踐活動(dòng)及校園法治文化環(huán)境方面存在的問(wèn)題。并進(jìn)一步從中國(guó)傳統(tǒng)法文化與社會(huì)主義法治觀念的沖突、西方自然法傳統(tǒng)與憲政思想的價(jià)值迷惑、現(xiàn)實(shí)司法運(yùn)作的弱公信力、高校人才培養(yǎng)中的教育偏離等維度,探究總結(jié)了當(dāng)代大學(xué)生法治觀念培育存在的困境。遵循“問(wèn)題——原因——對(duì)策”的邏輯,本文后三章聚焦于如何對(duì)當(dāng)代大學(xué)生進(jìn)行法治觀念培育。依據(jù)現(xiàn)實(shí)問(wèn)題和困境、國(guó)家與社會(huì)的期待、大學(xué)生個(gè)人成長(zhǎng)的規(guī)律和需求,本文第四章構(gòu)建了當(dāng)代大學(xué)生法治觀念培育相互聯(lián)系、層層遞進(jìn)的目標(biāo)體系,即使當(dāng)代大學(xué)生形成中國(guó)特色社會(huì)主義法治之理性認(rèn)知、產(chǎn)生社會(huì)主義法治價(jià)值之深度認(rèn)同、萌生敬畏法治之情感體驗(yàn)、進(jìn)而樹(shù)立建設(shè)社會(huì)主義法治國(guó)家之理想信念,并形成依法辦事之思維習(xí)慣。以中國(guó)特色社會(huì)主義法治為研究對(duì)象,本文所指的法治觀念在內(nèi)容上包含黨的領(lǐng)導(dǎo)、人民當(dāng)家作主與依法治國(guó)相統(tǒng)一觀念、依法治國(guó)與以德治國(guó)相結(jié)合觀念、法治的核心價(jià)值觀念、權(quán)利和義務(wù)觀念、權(quán)力的合理定位觀念及法律主治觀念。本文第五章著重于探討當(dāng)代大學(xué)生法治觀念培育的新方法及綜合路徑的運(yùn)用,提出了運(yùn)用于法律選修課的咨詢式教學(xué)法、運(yùn)用于學(xué)生行政管理的團(tuán)體教育法、及運(yùn)用于學(xué)生行為規(guī)范的遵紀(jì)守法信用檔案等具備時(shí)代特征和現(xiàn)實(shí)操作性的新方法。在教育路徑上,提出要優(yōu)化課堂教育,構(gòu)建大學(xué)生法治觀念培育課程體系;拓展實(shí)踐活動(dòng),為大學(xué)生法治觀念深化提供著力點(diǎn);營(yíng)造文化環(huán)境,使大學(xué)生產(chǎn)生法治沉浸體驗(yàn):開(kāi)發(fā)網(wǎng)絡(luò)資源,豐富大學(xué)生自主學(xué)習(xí)渠道;加強(qiáng)依法治校,發(fā)揮管理對(duì)大學(xué)生的教育功效,使各教育路徑發(fā)揮出綜合功效。最后,本文第六章致力于發(fā)揮當(dāng)代大學(xué)生法治觀念培育各要素的系統(tǒng)功效,提出構(gòu)建當(dāng)代大學(xué)生法治觀念培育的長(zhǎng)效機(jī)制。通過(guò)建立課堂法治觀念教育與日常法治管理并行機(jī)制、法治觀念理論教育與法治實(shí)踐引導(dǎo)互動(dòng)機(jī)制、學(xué)校法治觀念培育與社會(huì)法治宣傳教育協(xié)同機(jī)制、學(xué)校教育主體與政府、家庭、媒體等力量聯(lián)動(dòng)機(jī)制,實(shí)現(xiàn)當(dāng)代大學(xué)生法治觀念培育的長(zhǎng)效化、系統(tǒng)化、規(guī)范化。
[Abstract]:The rule of law is the pointer of the civilization of human society, the pursuit of the common values of all ethnic groups and the social ideal of contemporary China. The authority of the law derives from the inner support and sincere belief of the people. In the practice of the rule of law in contemporary China, the concept of the rule of law of the citizens plays a leading role and is the key to the realization of the ideal of the rule of law in China. The cultivation of the concept of rule of law is not only an important part of the cultivation system of the concept of the rule of law of our citizens, but also one of the important contents of modern higher education in China. This paper, guided by Marx theory, takes the perspective of Ideological and political education as an entry into the cultivation of socialist concept of socialist rule of law for contemporary college students, and uses literature analysis and qualitative analysis. The methods of unified analysis and social investigation are not only based on the reality, but also combing the history. They not only pay attention to the theoretical research, but also fall on the practice of education. They not only emphasize the innovation of the educational elements, but also attach importance to the establishment of long-term mechanism. The core of the whole thesis is to solve the problem of "how to correctly understand the cultivation of the rule of law for the students of the generation". This article is divided into three parts: introduction, text and conclusion, including six chapters in the text, which follows the basic logic of "clear the needs of the times - clear the historical context - clear realistic problems - inquiry mechanism strategy". The first chapter is the era of the concept of the rule of law for Contemporary College Students The rule of law is the strongest voice in the reform and development of contemporary China. It is a strong support in the "four comprehensive" strategic layout. It is an important guarantee for the goal of "two hundred years" and the great revival dream of the Chinese nation. The cultivation of the concept of rule of law for contemporary college students is the basis for China to carry out the rule of law in an all-round way. The link should be in line with the new system of the rule of law in China, the new public opinion and the requirements of the new practice. It is in line with the new expectation of the "Lide tree man" of higher education. From reality back to history, the second chapter of this article studies the historical experience of the cultivation of the concept of rule of law for college students in China since the reform and opening to the outside world, with the plan of seven universal universal law and the cultivation of university students' concept of rule of law. The process of cultivating the concept of rule of law of college students in China has been divided into four stages since the reform and opening up. It also summarizes the specific experience that has enlightenment to the cultivation of the concept of the rule of law for contemporary college students: to play the core role of the basic course of law in the cultivation of the concept of the rule of law of college students; to pay attention to the construction of campus culture for College Students The positive influence of the cultivation of the rule of law, the establishment of the concept of rule of law for college students by the rule of law, the close combination of the cultivation of the concept of rule of law and the moral education, and the standardization of the cultivation of the concept of the rule of law for College students, the institutionalized construction. The third chapter of this article analyzes the present situation of the concept of the rule of law of the contemporary college students and the contemporary university. The present situation of the cultivation of the concept of the rule of law and the multidimensional predicament facing the cultivation of the rule of law of college students. Through the social investigation of the cognition of the rule of law of the university students, the evaluation of the rule of law, the emotion of the rule of law and the rule of law, the present situation of the rule of law of the university students is not optimistic. At the same time, a detailed examination is made on the cultivation of the concept of the rule of law in college students. It also expounds the existing problems in the cultivation of the curriculum system of the concept of rule of law, the teaching of the legal basis, the practice of the rule of law and the cultural environment of the rule of law in the campus, and further from the conflict between the traditional Chinese law culture and the concept of the socialist rule of law, the value of the western natural law tradition and the constitutional thought, and the realistic judicature. The weak public credibility of the operation and the education deviation in the training of talents in Colleges and universities have explored and summed up the plight of the cultivation of the concept of rule of law for contemporary college students. The following three chapters focus on how to cultivate the concept of the rule of law for contemporary college students. In the fourth chapter, the author constructs the relationship between the rule of law of the contemporary college students and the target system of progressive development, even if the contemporary college students form the rational cognition of the socialist rule of law in the socialism with Chinese characteristics, the deep recognition of the value of the socialist law and the emotion of the rule of law in the fear of the socialist law. Experience, and then establish the ideal and belief of building a socialist country ruled by law, and form the habit of thinking in accordance with the law. Taking the rule of law of socialism with Chinese characteristics as the research object, the concept of rule of law in this article contains the leadership of the party, the concept of the unity of the people and the rule of law, the combination of the rule of law and the rule of virtue. The core values of the rule of law, the concept of rights and obligations, the concept of rational positioning of power and the concept of legal governance. The fifth chapter focuses on the exploration of the new methods and the application of the comprehensive path for the cultivation of the concept of rule of law for contemporary college students, and puts forward a consultative teaching method applied to the elective course of law and the group teaching in the administrative management of the students. In the education path, it is proposed to optimize the classroom education, to build up the curriculum system for the cultivation of the concept of the rule of law for college students, to expand the practical activities, to provide the focus for the deepening of the concept of the rule of law for college students, and to create a cultural environment, so as to create a cultural environment, so as to create a cultural environment. Students experience the immersion experience of the rule of law: developing network resources, enriching college students' independent learning channels, strengthening the management of school according to law, giving play to the educational efficacy of management to college students and making all the educational paths play a comprehensive effect. Finally, the sixth chapter of this article is devoted to the systematic efficacy of the modern college students' concept of rule of law to cultivate the various elements, and to put forward the construction of contemporary large scale. Through the establishment of the parallel mechanism of the concept of rule of law in the classroom and the daily rule of law management, the interaction mechanism between the theory of the concept of rule of law and the practice of the rule of law, the cooperative mechanism of the cultivation of the concept of rule of law and the publicity and education of the rule of law of the society, the linkage mechanism of the school education owners with the government, the family and the media, The concept of rule of law for contemporary college students is long-term, systematic and standardized.
