【摘要】：刑事政策是國家或執(zhí)政黨依據(jù)犯罪態(tài)勢對犯罪行為和犯罪大運用刑罰和有關措施以期有效地實現(xiàn)懲罰和預防犯罪的方略。蒙古人民共和國時期刑事政策著重保護公權力為己任,而1992年改制后的蒙古國刑事政策開始重視私權的保護。同樣中華人民共和國的刑事政策也從過去重視公權力到公私權兼顧的一種刑事政策過渡。蒙古國和中國是睦鄰友好國家,曾有過共同的歷史文化和相同的政治制度。但近30年來,兩國政治、經(jīng)濟、法律、文化諸領域發(fā)生了重要的變化,尤其在法律制度方面的制度性差異越來越大,值得兩國學者關注和比較研究,加強學術交流,以期為蒙中兩國經(jīng)濟社會發(fā)展服務。目前蒙中兩國法律制度比較研究的成果鮮有,鑒于此,本文以蒙古國和當代中國刑事政策進行了比較研究,以便探討雙方刑事法律領域的異同。本論文由導論、五章正文、結(jié)論及建議、參考文獻組成�！皩д摗辈糠謱φ撐牡倪x題依據(jù)、國內(nèi)外研究現(xiàn)狀、研究目的、研究方法、創(chuàng)新之處及研究意義進行了簡要說明。第一章對蒙中兩國從20世紀初以來的刑事政策歷史傳統(tǒng)及發(fā)展演變進行了梳理。第二章對兩國建國初期到2016年為止的刑事立法進行了比較。第三章對兩國刑法原則及刑罰種類進行了全面系統(tǒng)的比較研究。第四章對兩國刑事案件審理期限、當事人國領土與司法管轄諸問題作了比較。第五章以兩國的徒刑制度為例,對蒙古國與中國的刑事政策進行了深入研究。“結(jié)論和建議”部分基于前五章的相關內(nèi)容,對兩國刑事政{^的異同產(chǎn)生的原因和刑法特征作了法理學分析,并兩國在刑法領域互相借鑒方面提出了自己的建議和見解。“參考文獻”部分羅列了完成本課題時參考利用的基里爾蒙古文、傳統(tǒng)蒙古文、中文、俄文、英文資料。
[Abstract]:Criminal policy is a strategy for the state or the ruling party to make great use of penalties and related measures to punish and prevent crime according to the state of crime. Criminal policy in the period of the people's Republic of Mongolia focused on protection. Public power is one's duty. In 1992, Mongolia's criminal policy began to attach importance to the protection of private rights. Similarly, the criminal policy of the people's Republic of China has also shifted from public power to public and private rights. China is a good-neighborly and friendly country. There has been a common historical culture and the same political system. But in the past 30 years, important changes have taken place in the political, economic, legal and cultural fields of the two countries. Especially in the legal system, there are more and more institutional differences, which is worthy of the attention and comparative study of scholars of the two countries, and strengthen academic exchanges. In order to serve the economic and social development of Mongolia and China. At present, there are few achievements in the comparative study of Mongolian and Chinese legal systems. In view of this, this paper makes a comparative study on the criminal policy of Mongolia and contemporary China. In order to explore the similarities and differences in the field of criminal law between the two sides. This paper is composed of introduction, five chapters, conclusions and recommendations, reference literature. "introduction" part of the selected topics of the paper, domestic and foreign research status, research purposes. Research methods. The first chapter reviews the historical tradition and development of the criminal policy between Mongolia and China since 20th century. The second chapter deals with the history and evolution of the two countries' criminal policy from the beginning of the founding of the people's Republic of China to 2016. Chapter three makes a comprehensive and systematic comparative study on the criminal law principles and the types of penalties between the two countries. Chapter 4th makes a comparative study on the trial period of criminal cases between the two countries. The author makes a comparison between the territory of the country concerned and the jurisdiction of the jurisdiction. Chapter 5th takes the imprisonment system of the two countries as an example. The conclusions and suggestions are based on the relevant contents of the previous five chapters, and the causes of the similarities and differences between the two countries' criminal policies and the characteristics of the criminal law are analyzed in jurisprudence.
