【摘要】：標(biāo)準(zhǔn)是經(jīng)濟(jì)和產(chǎn)業(yè)的關(guān)鍵因素。近年來隨著國際貿(mào)易的不斷發(fā)展,國家之間的經(jīng)濟(jì)、社會和技術(shù)交流也日益頻繁。標(biāo)準(zhǔn)作為對外貿(mào)易、世界經(jīng)濟(jì)和產(chǎn)業(yè)的關(guān)鍵因素,在世界貿(mào)易中發(fā)揮著日益重要的作用。擁有一個國際標(biāo)準(zhǔn)就可以對世界經(jīng)濟(jì)產(chǎn)生一定的影響力,因此,世界各個國家都試圖將自己的標(biāo)準(zhǔn)發(fā)展成為國際標(biāo)準(zhǔn)。在一個標(biāo)準(zhǔn)里面,存在著復(fù)雜多樣的利害關(guān)系、關(guān)系到很多標(biāo)準(zhǔn)化的組織等政治因素,其表現(xiàn)在于國家的標(biāo)準(zhǔn)化政策。本文就是針對因產(chǎn)業(yè)標(biāo)準(zhǔn)的不同而產(chǎn)生的國際標(biāo)準(zhǔn)化糾紛的解決方案,進(jìn)行了研究。自從1982年的進(jìn)口自由化以來,韓國市場經(jīng)濟(jì)開始不斷發(fā)展。到1997年后,自由市場經(jīng)濟(jì)成為韓國經(jīng)濟(jì)的主體。韓國的經(jīng)濟(jì)發(fā)展也可以稱為標(biāo)準(zhǔn)的發(fā)展。標(biāo)準(zhǔn)的標(biāo)準(zhǔn)化工程改變了有關(guān)法律和政府部門的政策。比如,通訊行業(yè)的發(fā)展必須遵守通訊標(biāo)準(zhǔn);工業(yè)領(lǐng)域也要遵守相關(guān)標(biāo)準(zhǔn)等。標(biāo)準(zhǔn)的標(biāo)準(zhǔn)化對韓國政府、民間企業(yè)、社會以及經(jīng)濟(jì)等領(lǐng)域影響深遠(yuǎn)。為了確定國家標(biāo)準(zhǔn)規(guī)范政策的發(fā)展歷史,本文從早期工業(yè)標(biāo)準(zhǔn)化政策到如今,進(jìn)行了進(jìn)一步研究并試圖突出標(biāo)準(zhǔn)政策的變化特征。以1962年的《22012通過》為研究起點(diǎn),按時間段,說明了韓國標(biāo)準(zhǔn)化的演變。最后,本文著重了如何解決國家與國家之間因標(biāo)準(zhǔn)互不相同而導(dǎo)致的國際標(biāo)準(zhǔn)糾紛。本論文認(rèn)為國家主導(dǎo)保障標(biāo)準(zhǔn)的規(guī)范化乃是最佳的解決方案。
[Abstract]:Standards are key factors in economy and industry. In recent years, with the continuous development of international trade, economic, social and technological exchanges between countries have become increasingly frequent. Standards as a key factor in foreign trade, world economy and industry, Play an increasingly important role in world trade. Having an international standard can have some influence on the world economy. Therefore, every country in the world is trying to develop its own standard into an international standard. There are complex and diverse interests, related to a lot of political factors such as standardization organizations, its manifestation lies in the national standardization policy. This paper is aimed at the solution of international standardization disputes arising from the different industry standards. Since the liberalization of imports in 1982, the Korean market economy has been developing continuously. After 1997, The free market economy has become the main body of the Korean economy. The economic development of Korea can also be called the development of the standard. The standardization project of the standard has changed the relevant laws and the policies of the government departments. For example, the development of the communication industry must abide by the communication standard; The industrial field also has to abide by relevant standards. The standardization of standards has far-reaching effects on the Korean government, private enterprises, social and economic fields. In order to determine the history of the development of national standards and normative policies, From the early industrial standardization policy to the present, this paper makes a further study and tries to highlight the changing characteristics of the standard policy. With < 22012 adopted in 1962 as the starting point, the paper explains the evolution of Korean standardization according to the time period. Finally, This paper focuses on how to solve the international standard disputes caused by different standards between countries. This paper holds that the standardization of state-led guarantee standards is the best solution.
