【摘要】：在社會(huì)經(jīng)濟(jì)和科技高速發(fā)展的今天,環(huán)境問題與日俱增,亟需轉(zhuǎn)變傳統(tǒng)的政府環(huán)境命令管制治理模式。隨著社會(huì)公眾的環(huán)保意識(shí)不斷加強(qiáng),社會(huì)公眾成為環(huán)境治理工作開展的重要力量。傳統(tǒng)的政府環(huán)境命令管制模式在中國的環(huán)境治理工作中愈顯其弱勢,而近年來興起的社會(huì)治理的新理念為我國環(huán)境治理模式的創(chuàng)新與完善提供了方向與指導(dǎo)。2015年新修訂的《環(huán)境保護(hù)法》中,專章規(guī)定了信息公開和公眾參與,同時(shí)還建立了環(huán)境公益訴訟制度,相繼出臺(tái)了《關(guān)于推進(jìn)環(huán)境保護(hù)公眾參與的指導(dǎo)意見》、《環(huán)境保護(hù)公眾參與辦法》等一系列法律法規(guī)政策。這表明,我國已經(jīng)越來越重視環(huán)境治理工作中的公眾參與。本文以多元合作共治理念為視角,在強(qiáng)調(diào)多元化主體共同合作參與環(huán)境治理工作的前提下,分析了環(huán)境保護(hù)公眾參與制度及環(huán)境多元合作共治模式的涵義、環(huán)境多元合作共治模式所涉及的主要主體,并通過對(duì)傳統(tǒng)政府環(huán)境命令管制模式的缺陷分析,提出了引入多元化的主體參與環(huán)境治理工作的必要性及公眾參與對(duì)于環(huán)境多元合作共治模式的意義。首先,概述環(huán)境保護(hù)公眾參與制度及多元共治理念的相關(guān)概念,指出傳統(tǒng)政府環(huán)境命令管制模式的不足;其次,結(jié)合相關(guān)案例對(duì)我國環(huán)境保護(hù)公眾參與制度的現(xiàn)狀進(jìn)行分析,指出目前環(huán)境保護(hù)公眾參與制度的績效和在多元合作共治理念語境下存在的缺陷;最后,提出以多元合作共治為基礎(chǔ)的環(huán)境保護(hù)公眾參與制度的完善建議。
[Abstract]:With the rapid development of social economy and science and technology, environmental problems are increasing day by day. With the strengthening of public awareness of environmental protection, the public has become an important force in environmental governance. The traditional mode of government environmental order control has become more and more vulnerable in China's environmental governance work. The new concept of social governance, which has emerged in recent years, provides direction and guidance for the innovation and improvement of the environmental governance model in our country. In the newly revised Environmental Protection Law in 2015, a special chapter provides for information openness and public participation. At the same time, the system of environmental public interest litigation has been established, and a series of laws, regulations and policies have been issued successively, such as "guiding opinions on promoting Public participation in Environmental Protection", "measures for Public participation in Environmental Protection" and so on. This indicates that our country has paid more and more attention to public participation in environmental governance. From the perspective of the concept of multi-cooperative co-governance, this paper analyzes the meaning of the system of public participation in environmental protection and the mode of co-governance of environmental plural cooperation under the premise of emphasizing the cooperation of multiple subjects in environmental governance. The main subjects involved in the mode of environmental plural cooperation and co-management, and through the analysis of the defects of the traditional government environmental command control model, The necessity of introducing diversified subjects to participate in environmental governance and the significance of public participation to the mode of co-management of environmental plural cooperation are put forward. Firstly, it summarizes the related concepts of the system of public participation in environmental protection and the concept of pluralistic co-governance, and points out the shortcomings of the traditional mode of government environmental command regulation. Secondly, it analyzes the current situation of the system of public participation in environmental protection in China by combining relevant cases. The paper points out the performance of the public participation system of environmental protection and the defects in the context of the concept of multi-cooperation and co-governance. Finally, it puts forward some suggestions to improve the system of public participation in environmental protection based on multi-cooperation and co-governance.
