鄂爾多斯地區(qū)政府環(huán)境監(jiān)管問題研究

【摘要】:"十三五"時期,環(huán)境保護和生態(tài)文明建設都進入新常態(tài),經(jīng)濟發(fā)展呈現(xiàn)出高速增長的態(tài)勢,而伴隨著經(jīng)濟的增長,資源環(huán)境狀況卻急劇惡化,并且環(huán)境容量和資源消耗強度對經(jīng)濟發(fā)展所需將難以為繼。環(huán)境就是民生,有效的保護生態(tài)環(huán)境和合理的利用自然資源,需要依賴政府科學的決策,企業(yè)積極的配合,也需要每一個公民都承擔起保護環(huán)境的責任和義務。政府作為公共事務的直接管理者,在現(xiàn)代社會占據(jù)主導地位,擁有最強大的資源優(yōu)勢和領導權威,對環(huán)境的監(jiān)管有著不可推卸的責任。但是政府在環(huán)境監(jiān)管的過程中,存在著農(nóng)村環(huán)境監(jiān)管不到位、公眾參與度低、基層環(huán)境監(jiān)管能力薄弱等問題,制約著經(jīng)濟社會可持續(xù)發(fā)展的進程,經(jīng)濟發(fā)展與環(huán)境保護難以達到一個平衡點。因此,如何有效的治理環(huán)境污染、改善環(huán)境質量,成為鄂爾多斯市戰(zhàn)略發(fā)展的重點問題,也成為公眾關心的焦點問題;诘胤秸诃h(huán)境監(jiān)管過程中所處的地位及作用,本文以提出問題—分析問題—解決問題為邏輯主線,對鄂爾多斯地區(qū)政府環(huán)境監(jiān)管的現(xiàn)狀從監(jiān)管的職能機構、制度、體制、手段四個角度進行分析,在肯定成績的同時,認為政府對環(huán)境監(jiān)管存在以下問題:在監(jiān)管區(qū)域方面,政府環(huán)境規(guī)制重城市、輕農(nóng)村;在監(jiān)管制度方面,環(huán)境監(jiān)管公眾參與度低;在監(jiān)管體制方面,橫向層面各行其政,縱向層面監(jiān)管權力受限;在監(jiān)管手段方面,基層環(huán)境監(jiān)管能力薄弱。經(jīng)過分析研究,本文認為上述問題產(chǎn)生的原因分別是:政府環(huán)境監(jiān)管職能不完善;公眾參與制度不健全;環(huán)境監(jiān)管雙重領導,機制不完善;環(huán)保投入比重小,缺乏技術支撐。通過分析問題產(chǎn)生的原因并學習國外環(huán)境監(jiān)管先進經(jīng)驗,本文就加強鄂爾多斯地區(qū)政府環(huán)境監(jiān)管提出了規(guī)范政府責任,實現(xiàn)城鄉(xiāng)一體化監(jiān)管;加強促進公眾參與的相關制度建設;優(yōu)化環(huán)境監(jiān)管權力配置,健全環(huán)境監(jiān)管機制;推動和加強基層環(huán)境監(jiān)管能力建設等方面的對策建議。
[Abstract]:During the 13th Five-Year Plan period, environmental protection and the construction of ecological civilization both entered a new normal. Economic development showed a trend of rapid growth, but with the growth of the economy, the situation of resources and environment deteriorated sharply. And the environmental capacity and the intensity of resource consumption will be difficult to sustain the economic development. The environment is people's livelihood, the effective protection of ecological environment and rational use of natural resources, need to rely on the government scientific decision-making, enterprises actively cooperate, but also need every citizen to assume the responsibility and obligation to protect the environment. As the direct manager of public affairs, the government occupies a dominant position in modern society, has the most powerful resource advantage and leading authority, and has the unshirkable responsibility to supervise the environment. However, in the process of environmental supervision, there are some problems, such as the lack of rural environmental supervision, the low public participation, the weak capacity of grass-roots environmental supervision and so on, which restrict the process of sustainable economic and social development. It is difficult to achieve a balance point between economic development and environmental protection. Therefore, how to effectively control environmental pollution and improve environmental quality has become a key issue in the strategic development of Ordos, and has also become the focus of public concern. Based on the position and function of the local government in the process of environmental supervision, this paper takes putting forward the problem-analysis problem-solving problem as the logical main line, and analyzes the current situation of the government environmental supervision in Ordos region from the function organization, system and system of supervision. From four angles of analysis, the author thinks that the government has the following problems in environmental supervision: in the area of supervision, the government pays more attention to the city than the countryside, and the public participation in the environmental regulation is low in the aspect of the supervision system. In the aspect of the supervision system, the horizontal level has its own administration, the vertical level is limited; in the aspect of the supervision means, the basic level environmental supervision ability is weak. After analysis and research, this paper thinks that the reasons for the above problems are: the function of government environmental supervision is not perfect; the system of public participation is not perfect; the dual leadership of environmental regulation, the mechanism is not perfect; the proportion of environmental protection investment is small, lack of technical support. By analyzing the causes of the problems and learning the advanced experience of foreign environmental supervision, this paper puts forward to standardize the responsibility of the government to strengthen the environmental supervision in Ordos region and realize the integrated supervision of urban and rural areas. Strengthen the relevant system construction to promote public participation; optimize the allocation of environmental supervision power and improve the environmental regulatory mechanism; promote and strengthen the grass-roots environmental regulatory capacity building and other aspects of countermeasures and suggestions.
