【摘要】：改革開放的三十多年,我們?nèi)〉昧伺e世矚目的發(fā)展成就,然而發(fā)展帶來的環(huán)境污染也觸目驚心。雖然各級(jí)政府一直沒有停止過環(huán)境的治理,并取得了一定的成效。但是,并未能從根本上解決環(huán)境問題。一方面,受“城市中心主義”思想的影響,我們?cè)诃h(huán)境治理投入方面一直存在“重城市而輕農(nóng)村”的問題;另一方面,由于城市環(huán)保標(biāo)準(zhǔn)的提高和農(nóng)村經(jīng)濟(jì)發(fā)展的需要,大量城市工業(yè)污染源轉(zhuǎn)向了農(nóng)村。當(dāng)下,記憶中農(nóng)村的青山綠水和田園風(fēng)光正在逐漸消亡。作為城市的生態(tài)屏障,農(nóng)村環(huán)境的惡化又將反過來影響城市。隨著城鄉(xiāng)的進(jìn)一步融合,城鄉(xiāng)關(guān)系將變得越來越密切,在全面推進(jìn)新型城鎮(zhèn)化戰(zhàn)略的大背景下,必須打破城鄉(xiāng)二元結(jié)構(gòu),走城鄉(xiāng)一體化環(huán)境治理路線。文章擬從城鄉(xiāng)環(huán)保一體化的基本概念入手,運(yùn)用環(huán)境治理的相關(guān)理論,結(jié)合美國(guó)的成功經(jīng)驗(yàn),為我國(guó)城鄉(xiāng)環(huán)保一體化發(fā)展的法制建設(shè)提出對(duì)策。文章一共包括六個(gè)部分。第一個(gè)部分是緒論,作為文章的切入點(diǎn),本部分主要交代了研究的背景意義、國(guó)內(nèi)外學(xué)者研究成果,文章的研究思路與內(nèi)容以及研究所運(yùn)用的方法和技術(shù)。第二個(gè)部分是城鄉(xiāng)環(huán)保一體化發(fā)展的理論闡釋,這一部分首先對(duì)城鄉(xiāng)環(huán)保一體化的概念進(jìn)行了界定,在此基礎(chǔ)上進(jìn)一步闡述了環(huán)境正義理論、城鄉(xiāng)統(tǒng)籌理論和協(xié)同治理理論,為下一步發(fā)現(xiàn)和解決問題提供理論基礎(chǔ)。第三部分是在理論研究的基礎(chǔ)上對(duì)我國(guó)城鄉(xiāng)環(huán)保一體化發(fā)展的成效進(jìn)行描述,主要從政策層面、立法層面進(jìn)行了歸納和總結(jié),并以張家港、常熟和攸縣為案例,通過實(shí)證展示我國(guó)城鄉(xiāng)環(huán)保一體化發(fā)展的成效及經(jīng)驗(yàn)。第四部分對(duì)我國(guó)城鄉(xiāng)環(huán)保一體化發(fā)展存在的問題進(jìn)行了探究,并對(duì)問題產(chǎn)生的原因進(jìn)行了深入的法律分析和探討。文章認(rèn)為由于城鄉(xiāng)居民環(huán)境權(quán)的不正義、城鄉(xiāng)環(huán)境立法的不平衡、城鄉(xiāng)環(huán)境財(cái)政投入的不平衡以及城鄉(xiāng)環(huán)境法律管制不平衡等原因,造成了目前我國(guó)城鄉(xiāng)環(huán)境治理的城鄉(xiāng)非均衡發(fā)展和城鄉(xiāng)環(huán)保差距的不斷擴(kuò)大。第五部分對(duì)美國(guó)城鄉(xiāng)環(huán)保一體化發(fā)展法制建設(shè)的經(jīng)驗(yàn)進(jìn)行了總結(jié)歸納。認(rèn)為美國(guó)在強(qiáng)化立法發(fā)展可持續(xù)農(nóng)業(yè)、農(nóng)村環(huán)境保護(hù)法規(guī)制定、科學(xué)執(zhí)法、公眾參與環(huán)境立法與執(zhí)法等方面的經(jīng)驗(yàn)值得我們借鑒。第六部分提出我國(guó)城鄉(xiāng)環(huán)保一體化發(fā)展的法律對(duì)策,即從強(qiáng)化環(huán)境正義的立法理念、完善環(huán)境法制建設(shè)、增加財(cái)政投入以及健全城鄉(xiāng)一體的環(huán)境治理機(jī)制等方面對(duì)我國(guó)進(jìn)一步完善城鄉(xiāng)環(huán)保一體化發(fā)展的法制建設(shè)提出了建議。
[Abstract]:Thirty years of reform and opening up, we have made remarkable achievements in development, but the development has brought environmental pollution is shocking. Although the government has not stopped the environmental governance, and achieved certain results. However, it failed to fundamentally solve the environmental problems. On the one hand, influenced by the "city center" we thought, in environmental governance investment there has always been "heavy and light rural city"; on the other hand, due to the need to improve the city's environmental standards and the development of rural economy, a large number of industrial pollution sources in the city to the countryside. At present, the memory of the rural and pastoral scenery of green mountains and rivers are gradually disappearing as the ecological barrier. City, deterioration of rural environment will in turn affect the city. With the further integration of urban and rural areas, the relationship between urban and rural areas will become more and more closely, in promoting new urbanization The background of the strategy, we must break the two structure in urban and rural areas, urban-rural integration of environmental governance route. This paper starts from the basic concept of the integration of urban and rural environmental protection, using the related theories of environmental governance, combined with the successful experience of the United States, put forward the Countermeasures for the construction of legal system of China's urban and rural integration of environmental protection and development. The paper includes a total of six part. The first part is the introduction, as the entry point, this part mainly introduces the background and significance of the study, domestic and foreign scholars research results, methods and techniques used by the research ideas and content as well as the research. The second part is the theoretical interpretation of the integrated development of urban and rural environmental protection, this part of the first concept of integration urban and rural environmental protection are defined, further elaborated on the basis of the theory of environmental justice, the theory of urban and rural areas and collaborative governance theory, the next step for the discovery and solve problems Provide theoretical basis. The third part is on the development of the integration of urban and rural environmental protection in our country. The effectiveness on the basis of theoretical research, mainly from the policy level, the legislative level are summarized, and in Zhangjiagang, Changshu and Youxian as the case, through the empirical experience and demonstrate the effectiveness of the integrated development of urban and rural environmental protection in China. Fourth part of the research on the existence and development of the integration of urban and rural environmental problems in China, and the causes for the problems of legal analysis and discussion. The article thinks that due to urban and rural residents environmental right is not justice, unbalanced urban and rural environmental legislation, and the imbalance of urban and rural environmental legal regulation imbalance of urban and rural environment of financial investment the cause of the current environmental governance in urban and rural areas of urban and rural non balanced development and the widening gap between the urban and rural environmental protection. The fifth part of the urban and rural integration of environmental protection The development of the legal system construction experience was summarized. Strengthen the legislation that the United States in the development of sustainable agriculture, develop rural environmental protection regulations, scientific law enforcement, public participation in environmental legislation and law enforcement and other aspects of the experience is worth learning. The sixth part puts forward the Legal Countermeasures of the integrated development of urban and rural environmental protection in our country, from the legislative idea of strengthening environmental justice. Perfect the construction of environmental legal system, increase financial input and environmental governance mechanism and improve the urban and rural development and puts forward some suggestions on the construction of China's legal system to further improve the integrated development of urban and rural environmental protection.
