【摘要】：加強法治建設(shè),全面推進依法治國是實現(xiàn)國家治理體系和治理能力現(xiàn)代化的重要保障,是黨中央治國理政新理念新思想新戰(zhàn)略的重要組成部分,是實現(xiàn)和維護國家長治久安的重要政治基礎(chǔ)。改革開放以來,以GDP為主要衡量標(biāo)尺的發(fā)展模式使得我國經(jīng)濟持續(xù)發(fā)展遇到了瓶頸,粗放型經(jīng)濟發(fā)展方式下,我國的生態(tài)環(huán)境遭到了嚴(yán)重的破壞,資源浪費嚴(yán)重。當(dāng)前,生態(tài)問題已經(jīng)滲透到經(jīng)濟社會發(fā)展的各個領(lǐng)域,成為威脅人類生存的隱性炸彈。加強生態(tài)文明建設(shè),轉(zhuǎn)變經(jīng)濟發(fā)展方式,激發(fā)我國經(jīng)濟社會發(fā)展的內(nèi)生動力和活力,勢在必行。進入21世紀(jì),生態(tài)法治逐步上升為國家戰(zhàn)略,以法治思維治理生態(tài)問題、以法治手段應(yīng)對生態(tài)危機的理念已經(jīng)深入人心。這就為學(xué)術(shù)界開展生態(tài)法治的理論研究提供了活生生的現(xiàn)實基礎(chǔ)和前提。本文以我國經(jīng)濟社會發(fā)展面臨的嚴(yán)重生態(tài)問題或生態(tài)瓶頸為現(xiàn)實關(guān)切,以超級文化基因理論為研究視角,在梳理國內(nèi)外關(guān)于生態(tài)法治問題研究的基礎(chǔ)上,進一步分析我國生態(tài)法治的現(xiàn)狀和原因,深入探討當(dāng)前我國生態(tài)法治建設(shè)的非理性因素及其規(guī)避策略,以期為我國生態(tài)法治系統(tǒng)的建設(shè)和完善提供具有創(chuàng)造性和可行性的解決策略,為我國生態(tài)問題的解決、加快生態(tài)文明建設(shè)、建設(shè)美麗中國奠定良好的法治基礎(chǔ),形成濃郁的生態(tài)法治文化氛圍。
[Abstract]:Strengthening the construction of the rule of law and comprehensively promoting the rule of law is an important guarantee for the modernization of the national governance system and governance capacity, and an important part of the new ideas and new strategies of the CPC Central Committee for governing the country, It is an important political foundation to realize and maintain the long-term stability of the country. Since the reform and opening up, the development model with GDP as the main yardstick has made the sustained economic development of our country meet with the bottleneck, under the extensive economic development mode, The ecological environment of our country has been seriously damaged and the waste of resources has been serious. At present, ecological problems have penetrated into all fields of economic and social development and become a hidden bomb threatening the survival of mankind. It is imperative to change the mode of economic development and stimulate the endogenous power and vitality of our country's economic and social development. Since 21th century, the ecological rule of law has gradually risen into a national strategy, and the ecological problems have been managed by the thinking of the rule of law. The idea of dealing with ecological crisis by means of rule of law has been deeply rooted in the people's heart, which provides a living realistic foundation and premise for the academic circles to carry out the theoretical research on ecological rule of law. This article is based on the serious development of our country's economic and social development. State problems or ecological bottlenecks are realistic concerns, From the perspective of super cultural gene theory, on the basis of combing the research on ecological rule of law at home and abroad, this paper further analyzes the present situation and reasons of ecological rule of law in China. In order to provide creative and feasible solutions for the construction and perfection of the ecological rule of law system in China, the irrationality factors and its evading strategies in the construction of ecological rule of law in China are discussed in depth, and the solution of ecological problems in our country is also discussed. Speed up the construction of ecological civilization, build a beautiful China to lay a good foundation for the rule of law, and form a rich culture of ecological rule of law atmosphere.
