【摘要】：生態(tài)環(huán)境保護是京津冀協(xié)同發(fā)展戰(zhàn)略需要實現(xiàn)率先突破的三大任務(wù)之一。這就需要京津冀三地在環(huán)境保護領(lǐng)域展開廣泛聯(lián)合、竭誠合作,共同探索區(qū)域共治的發(fā)展道路,而適配且協(xié)同的法律制度則是三地實現(xiàn)協(xié)同發(fā)展并取得預(yù)期效果的基本保障。其中,環(huán)境監(jiān)測作為環(huán)境保護工作的基礎(chǔ)性環(huán)節(jié),構(gòu)成京津冀區(qū)域?qū)崿F(xiàn)環(huán)境保護領(lǐng)域率先突破的突破口。本文主要從對環(huán)境監(jiān)測法律制度的考察入手,立足于京津冀三地環(huán)境監(jiān)測的法治情況,通過對比三地在政策、法規(guī)等方面的差異與沖突,圍繞“如何完善京津冀區(qū)域環(huán)境監(jiān)測法律制度的協(xié)同發(fā)展”這一主題,分環(huán)境監(jiān)測的法律解析、實踐進展、存在問題、完善建議等四個部分進行了深入研究。環(huán)境監(jiān)測在政策法律上協(xié)同,具有合理性并有一定的實踐基礎(chǔ)。環(huán)境監(jiān)測法律制度的功能為其在區(qū)域協(xié)同提供了理論指導(dǎo),京津冀三地在實踐中展開的政策法律協(xié)調(diào)實踐則為其奠定了實踐基礎(chǔ)。京津冀區(qū)域環(huán)境監(jiān)測協(xié)同法律制度是環(huán)境監(jiān)測法律制度的有機組成部分,是寓于京津冀區(qū)域協(xié)同發(fā)展的基礎(chǔ)性工程。對比分析三地在環(huán)境監(jiān)測法律規(guī)制上的差異和沖突,是尋找三地在環(huán)境監(jiān)測上實現(xiàn)協(xié)同發(fā)展的有效路徑。當前三地在環(huán)境監(jiān)測主體制度建設(shè)、環(huán)境監(jiān)測事權(quán)界限、環(huán)境監(jiān)測對象范圍、環(huán)境監(jiān)測標準體系、環(huán)境監(jiān)測程序和信息共享使用上存在諸多不協(xié)調(diào),阻滯了三地協(xié)同發(fā)展的進程。因此,為了確保京津冀區(qū)域環(huán)境監(jiān)測法律制度能夠有效的協(xié)同發(fā)展,就離不開強有力的制度保障。即強化立法協(xié)作,推動三地環(huán)境監(jiān)測制度同步建設(shè);構(gòu)建多元主體,深化三地環(huán)境監(jiān)測協(xié)同體制機制;規(guī)范監(jiān)測領(lǐng)域,促進三地監(jiān)測質(zhì)量聯(lián)動能力提升;統(tǒng)一監(jiān)測標準,確保三地環(huán)境監(jiān)測程序技術(shù)規(guī)范協(xié)調(diào);共享監(jiān)測信息,加強三地監(jiān)測信息和數(shù)據(jù)管理。
[Abstract]:Ecological environmental protection is one of the three major Ren Wuzhi that needs to achieve a breakthrough in the coordinated development strategy of Beijing-Tianjin-Hebei. This requires the three places of Beijing, Tianjin and Hebei to carry out extensive joint efforts in the field of environmental protection, cooperate wholeheartedly and jointly explore the development path of regional co-governance. And the suitable and coordinated legal system is the basic guarantee to realize the coordinated development and achieve the expected results in the three places. Among them, environmental monitoring is the basic link of the environmental protection work. Constitute the breakthrough of the first breakthrough in the field of environmental protection in the Beijing-Tianjin-Hebei region. This paper mainly starts with the investigation of the legal system of environmental monitoring, based on the legal situation of environmental monitoring in the three places of Beijing, Tianjin and Hebei, and compares the policies of the three places. The differences and conflicts in laws and regulations, focusing on the theme of "how to perfect the coordinated development of the legal system of environmental monitoring in the Beijing-Tianjin-Hebei region", are divided into legal analysis, practical progress and existing problems of environmental monitoring. Four parts, such as perfecting suggestions, are studied in depth. Environmental monitoring is coordinated in policy and law, has rationality and has certain practical foundation. The function of legal system of environmental monitoring provides theoretical guidance for its coordination in regional areas. The practice of policy and law coordination in the practice of Beijing-Tianjin-Hebei has laid a practical foundation for it. The coordinated legal system of environmental monitoring in the Beijing-Tianjin-Hebei region is an organic part of the legal system of environmental monitoring. It is a basic project for the coordinated development of the Beijing-Tianjin-Hebei region. The differences and conflicts between the three places in the legal regulation of environmental monitoring are compared and analyzed. It is an effective way to find an effective way to realize the coordinated development of environmental monitoring in the three places. At present, the three places are building the main body system of environmental monitoring, the limits of environmental monitoring authority, the scope of environmental monitoring objects, and the environmental monitoring standard system. There are many incoordination between environmental monitoring procedures and the use of information sharing, which hinder the process of coordinated development of the three places. Therefore, in order to ensure that the legal system of environmental monitoring in the Beijing-Tianjin-Hebei region can develop in an effective and coordinated manner, It is necessary to strengthen the legislative cooperation to promote the synchronous construction of the environmental monitoring system in the three places; to construct multiple subjects, to deepen the synergistic system mechanism of environmental monitoring in the three places; to standardize the monitoring field; To promote the quality linkage of monitoring in the three places; to unify the monitoring standards to ensure the coordination of the technical specifications of the environmental monitoring procedures in the three places; to share monitoring information and strengthen the monitoring information and data management in the three places.
