【摘要】：區(qū)域限批制度于2006年開始運(yùn)用在地方政府環(huán)保實(shí)踐當(dāng)中,2007年,原國家環(huán)保總局首次從國家層面正式啟用區(qū)域限批制度,隨后得到許多地方政府紛紛效仿,將該制度逐漸普及到地方環(huán)保治理領(lǐng)域。作為我國在環(huán)境保護(hù)領(lǐng)域的創(chuàng)新性制度安排,它的產(chǎn)生有著深刻復(fù)雜的背景。改革開放以來,雖然國家在經(jīng)濟(jì)領(lǐng)域?qū)崿F(xiàn)了突破性的進(jìn)展,但是我們也需注意到許多經(jīng)濟(jì)成就取得的背后往往是以犧牲生態(tài)環(huán)境為獲取代價的,發(fā)展理念的偏差致使國家的整體生態(tài)環(huán)境問題越來越嚴(yán)重,先前國家采取的環(huán)境保護(hù)舉措也沒有達(dá)到預(yù)期的效果,這就引起政府和社會公眾的高度關(guān)注和思考,區(qū)域限批制度也在這種環(huán)境中應(yīng)運(yùn)而生。區(qū)域限批制度作為一次有效的制度創(chuàng)新,在轉(zhuǎn)變地方政府官員的發(fā)展理念,約束地方政府不合理的經(jīng)濟(jì)行為和實(shí)現(xiàn)區(qū)域生態(tài)環(huán)境優(yōu)化等方面發(fā)揮著舉足輕重的作用。雖然區(qū)域限批制度已經(jīng)得到立法上的確認(rèn),并在政府環(huán)保實(shí)踐中發(fā)揮著重要功能,但區(qū)域限批制度在內(nèi)容和實(shí)踐層面仍然存在許多缺陷,因此,急需對區(qū)域限批制度做出合理完善和改進(jìn)。文章第一部分為緒論。主要介紹論文的研究背景與選題意義,論文研究主題區(qū)域限批制度的研究綜述,及論文的研究方法和研究思路。第二部分為區(qū)域限批制度概述。在對區(qū)域限批制度內(nèi)涵進(jìn)行界定的基礎(chǔ)上,結(jié)合目前該制度實(shí)施現(xiàn)狀敘述了區(qū)域限批制度的構(gòu)成與演進(jìn),同時對問題研究的理論基礎(chǔ)作了闡述。第三部分重點(diǎn)論述區(qū)域限批制度的重要性,并對其之所以取得如此顯著環(huán)保成效的獨(dú)特制度優(yōu)勢進(jìn)行了總結(jié)概括。第四部分重點(diǎn)分析我國區(qū)域限批制度在內(nèi)容規(guī)定和實(shí)踐操作過程里面存在的缺陷。第五部分文章依據(jù)第四部分的總結(jié)內(nèi)容,從六個方面針對性地提出提高我國區(qū)域限批制度運(yùn)行有效性的對策與建議。第六部分為結(jié)語。文章在肯定區(qū)域限批制度環(huán)保成效的同時,認(rèn)為區(qū)域限批制度不應(yīng)該常態(tài)化,且需在今后實(shí)踐中不斷完善改進(jìn)。
[Abstract]:In 2006, the regional limited approval system began to be used in the practice of local government environmental protection. In 2007, the former State Environmental Protection Administration formally launched the regional limited approval system from the national level for the first time. Subsequently, many local governments followed suit, gradually popularizing the system to local environmental governance, as the innovative institutional arrangements in the field of environmental protection in China. It has a profound and complex background. Since the reform and opening up, although the country has achieved a breakthrough in the economic field. However, we also need to note that many economic achievements are often made at the expense of the ecological environment as the cost, the deviation of the concept of development makes the overall ecological environment problems of the country more and more serious. Previous national environmental protection measures have not achieved the desired results, which has caused the government and the public to pay close attention and thinking. As an effective institutional innovation, the regional limited approval system is changing the development concept of local government officials. Constraining the unreasonable economic behavior of local government and realizing the optimization of regional ecological environment play an important role, although the system of regional limited approval has been confirmed by legislation. And play an important role in the practice of government environmental protection, but there are still many defects in the content and practice of the system. The first part is the introduction. It mainly introduces the research background and the significance of the topic, and summarizes the research of the regional limited approval system. The second part is an overview of the regional limited approval system. On the basis of defining the connotation of the regional limited approval system. Combined with the current implementation of the system described the composition and evolution of the regional limited approval system, at the same time, the theoretical basis of the study is expounded. The third part focuses on the importance of the regional limited approval system. The paper summarizes the unique institutional advantages of this remarkable environmental protection effect. Part 4th focuses on the analysis of the defects of the regional limited approval system in the process of content regulation and practical operation. 5th parts. According to the 4th part of the summary content. This paper puts forward the countermeasures and suggestions to improve the effectiveness of the regional limited approval system from six aspects. Part 6th is the conclusion. The article affirms the environmental protection effectiveness of the regional limited approval system. It is suggested that the regional limited approval system should not be regularized and should be perfected and improved in practice in the future.
