【摘要】：隨著人類社會的發(fā)展,特別是現(xiàn)代化進程的加快,環(huán)境問題日益凸顯,已成為關系到人類生存、發(fā)展的重要議題。環(huán)境保護基金制度作為一項新興事物,為環(huán)境問題的解決提供了一個可能性途徑。但自環(huán)境保護基金制度引入中國以來,并沒有發(fā)揮其自身應有的作用,環(huán)境保護基金法律制度也飽受詬病,有待進一步完善。本文旨在嘗試克服傳統(tǒng)視野下“唯制度論”的研究弊病,因循公共治理理論從環(huán)境治理角度著手,深入探討法律制度背后的深層次原因。本文在論述過程中運用了實證分析的、比較的、法哲學的以及法經濟學的分析方法,基于當前中國式權威型環(huán)境治理背景進行分析,得出環(huán)境保護基金法律制度困境根源于權威型環(huán)境治理所造成的環(huán)境公共利益的混同和掠奪、科層矛盾與利益妥協(xié)、參與限制與環(huán)境民主回避。在此基礎上,結合中國環(huán)境保護基金法律制度現(xiàn)狀,總結國外立法、實踐經驗,最終得出結論,并從宏觀、中觀、微觀三個層面進行改良和完善,以公共治理為路徑對環(huán)境保護基金法律制度進行重構。
[Abstract]:With the development of human society, especially the acceleration of the modernization process, environmental problems have become increasingly prominent, has become an important issue related to the survival and development of human beings. Environmental protection fund system as a new thing. It provides a possible way to solve environmental problems. However, since the introduction of the environmental protection fund system into China, it has not played its due role, and the legal system of environmental protection fund has also been criticized. The purpose of this paper is to overcome the disadvantages of "institutionalism" in the traditional view, and to proceed from the perspective of environmental governance according to the theory of public governance. This paper discusses the deep reasons behind the legal system. In the process of discussion, this paper uses empirical analysis, comparative analysis, philosophy of law and law and economics analysis methods. Based on the analysis of the background of the current authoritative environmental governance in China, it is concluded that the dilemma of the legal system of the environmental protection fund is rooted in the confusion and plunder of the environmental public interests caused by the authoritative environmental governance. On this basis, combined with the current situation of China's environmental protection fund legal system, summed up foreign legislation, practical experience, and finally came to a conclusion, and from the macro. At the middle and micro level, the author reconstructs the legal system of environmental protection fund with public governance as the path.
