【摘要】：土壤是人類的生存之本,土壤的環(huán)境關(guān)系著土壤產(chǎn)物的質(zhì)量,關(guān)系著人類的身體健康。然而,近些年來(lái),大片土壤受到嚴(yán)重污染,土壤污染情況十分嚴(yán)峻,已然成為了一個(gè)世界性的難題,我國(guó)也不例外。但是,土壤污染的治理需要大量的資金,我國(guó)土壤污染治理資金來(lái)源的不穩(wěn)定性等問(wèn)題,導(dǎo)致實(shí)踐中土壤污染治理工作的開(kāi)展困難重重。本文認(rèn)為構(gòu)建土壤污染治理專項(xiàng)基金制度較為必要與可行,從法律規(guī)范角度看,目前我國(guó)土壤污染治理基金制度已形成了基本的雛形,但尚未完全建立起來(lái),土壤污染治理專項(xiàng)基金的現(xiàn)行立法存在著一定的問(wèn)題。本文將從土壤污染治理基金的基本內(nèi)涵,我國(guó)土壤污染治理專項(xiàng)基金的現(xiàn)行立法概況,現(xiàn)行立法存在的問(wèn)題,典型國(guó)家土壤污染基金制度借鑒以及我國(guó)土壤污染治理專項(xiàng)基金的立法完善等這五個(gè)方面進(jìn)行較為深入的探討。本文第一部分,介紹了土壤污染治理專項(xiàng)基金基本內(nèi)涵,包括土壤污染的概述以及土壤污染專項(xiàng)基金的概述與意義,具體有土壤污染的概念、特征、危害,治理、環(huán)境保護(hù)基金、土壤污染治理基金及其理論和現(xiàn)實(shí)意義。第二部分,梳理了我國(guó)現(xiàn)行與土壤污染治理專項(xiàng)基金相關(guān)的規(guī)范性法律文件,并且按照憲法與法律、行政法規(guī)、部門規(guī)章、地方性法規(guī)與地方政府規(guī)章的法律位階對(duì)重要的法律法規(guī)以及重要的法律條款進(jìn)行羅列。第三部分,對(duì)我國(guó)土壤污染治理專項(xiàng)基金現(xiàn)行立法進(jìn)行分析,從立法的形式與立法的內(nèi)容入手,找到現(xiàn)行立法中的問(wèn)題。立法形式上的問(wèn)題包括立法分散性較大、立法附屬性較強(qiáng)、立法層次性較低;立法內(nèi)容上的問(wèn)題包括立法空白、重復(fù)立法、可操作性不足等。第四部分,介紹美國(guó)、德國(guó)、日本這三個(gè)國(guó)家的土壤污染基金制度的立法現(xiàn)狀,然后從基金的來(lái)源、基金的使用以及基金的監(jiān)管等方面闡述其基本內(nèi)容,并進(jìn)行簡(jiǎn)要的述評(píng)總結(jié),最后找出這三國(guó)土壤污染基金制度對(duì)我國(guó)的啟示。第五部分,基于文章前面幾部分的研究,針對(duì)我國(guó)土壤污染治理基金相關(guān)立法存在的問(wèn)題,結(jié)合國(guó)外的先進(jìn)經(jīng)驗(yàn)與國(guó)內(nèi)的實(shí)際情況,嘗試對(duì)我國(guó)現(xiàn)有的土壤污染治理專項(xiàng)基金進(jìn)行立法完善。立法的形式上,建議從專門性的高位階立法《土壤污染治理專項(xiàng)基金條例》、具體配套的地方性立法兩方面進(jìn)行完善;立法的內(nèi)容上,從整合法律規(guī)定并提高可操作性、創(chuàng)新法律規(guī)范內(nèi)容并填補(bǔ)立法空白等方面進(jìn)行完善。
[Abstract]:Soil is the source of human survival. The environment of the soil is related to the quality of the soil products and the health of the human body. However, in recent years, large areas of soil have been seriously polluted, soil pollution is very severe, has become a worldwide problem, China is no exception. However, the management of soil pollution needs a lot of money. The problem of instability of sources of funds in China's soil pollution leads to difficulties in soil pollution control in practice. This paper thinks that the construction of soil pollution control special fund system is necessary and feasible, from the legal perspective, China's soil pollution control fund system has formed the basic shape, but has not been fully established, the current legislation of soil pollution special fund deposit in a certain problem. This article from the basic connotation of the soil pollution control fund, the current legislation situation of China's soil pollution special funds, the current legislation of the existing problems, from soil pollution fund system of typical countries and China soil pollution control special fund legislation etc. these five aspects are deeply discussed. The first part of this paper introduces the basic connotation of special fund of soil pollution, including soil pollution and soil pollution of special fund with an overview of the significance, concept, characteristics and harm of the soil pollution, governance, environmental protection funds, soil pollution control fund and its theoretical and practical significance. The second part reviews the normative legal documents of China's current fund associated with the soil pollution control projects, and in accordance with the Constitution and the laws, administrative regulations, department regulations, local regulations and local government regulations of the legal order of important laws and rules of the legal section list. The third part analyzes the current legislation of the special fund for soil pollution control in China, and finds out the problems in the current legislation from the legislative form and legislative content. The legislative problems include large decentralization, strong legislative attributes and low level of legislation. The legislative contents include legislative blank, repeated legislation and lack of operability. The fourth part introduces the legislative situation of soil pollution, the three national fund system of the United States, Germany, Japan, and then discusses the basic content from the use of the sources of funds, funds and fund supervision and other aspects, and summarized the brief review, and finally find out the implications of this three soil pollution fund system in our country. The fifth part, based on the research in the front part of the article, aiming at the problems existing in the legislation of soil pollution control fund in China, combined with the advanced experience of foreign countries and the actual situation in China, we try to improve the existing special fund for soil pollution control in China. The form of legislation, recommendations from the special high order "soil pollution control legislation of special fund regulations", specific supporting local legislation two aspects; the legislation content, from the integration of law and improve the operability and innovative content of legal norms and fill legislative gaps and other aspects.
