【摘要】：本論文選擇云南這個中國邊疆多民族地區(qū)作為研究地點,把基督教的傳播與法律治理作為研究對象,分析基督教在云南傳播的歷史進程、傳播過程中凸顯的問題以及法律對其治理情況,同時提出對加強我國宗教工作法治化建設(shè)的思考與建議,以圖對民族宗教間的糾紛、沖突、隱患予以解決和化解,從而提高云南省宗教事務管理的水平,實現(xiàn)依法管理宗教活動和依法保障宗教信仰自由的目的。本文的前四章內(nèi)容主要介紹了選題、基督教在云南傳播歷史、傳播中的問題及對非法傳播的治理等。其中引言部分,對本論文的選題背景,研究意義進行了說明,同時對與本論文相關(guān)的國內(nèi)外研究成果進行梳理、歸納和總結(jié)。第一章,先對基督教的產(chǎn)生原因及其歷史發(fā)展進行了簡述,同時對基督教的特征及其定義進行了歸納總結(jié),確定論文所研究基督教的內(nèi)涵和外延,再對基督教傳入中國的歷史進行梳理,并回顧了基督教進入云南,在云南傳播的歷史進程。第二章,從當代基督教在云南的傳播情況及存在的問題為研究重點,首先介紹了在新中國成立后“三自愛國”運動的興起。其次,研究云南宗教信仰狀況及基督教對云南邊境、少數(shù)民族生活、習慣所產(chǎn)生的影響。最后,對基督教在云南傳播過程中凸顯的如地下教會、家庭教會、利用網(wǎng)絡(luò)非法傳教等問題進行分析,對部分傳教士背離基督教“平等、自由、博愛”精神產(chǎn)生的極端宗教思想,境內(nèi)外敵對勢力利用宗教方式滲透我國邊疆地區(qū),弱化我國民族意識、國家認同等問題進行了剖析。第三章,從宗教法治化的角度研究基督教在云南傳播的法律治理方式及啟示。分析了世界上宗教治理模式的優(yōu)缺點,對國外宗教的治理經(jīng)驗進行介紹和總結(jié),并對我國唐朝法令、清朝律例以及民國政府對有關(guān)宗教管理和傳播限定進行考據(jù)研究,再分析云南對基督教非法傳播的法律治理現(xiàn)狀,從而得出在宗教法治化的情況下具有一些普適性的,對宗教治理行之有效的基本原則。第四章是對全文的總結(jié),在宗教法治化對云南治理的啟示基礎(chǔ)上,提出對完善我國宗教法治建設(shè)的思考。首先論證了在我國目前建立宗教法治體系的必要性。其次,論述了如何處理好宗教法治化管理與信仰自由的關(guān)系,如何處理好國家政策與國家法律的關(guān)系等問題。最后,提出促進我國宗教科學立法、加強我國宗教嚴格執(zhí)法和實行對宗教政策法規(guī)的全民普法等具體建議措施。
[Abstract]:This paper chooses Yunnan, a multinational region of China's frontier, as the research site, takes the spread of Christianity and its legal governance as the object of study, and analyzes the historical process of the spread of Christianity in Yunnan. In order to resolve the disputes, conflicts and hidden dangers between nationalities and religions, the problems highlighted in the process of communication and the situation of its governance by law are put forward, and some suggestions are put forward to strengthen the construction of the rule of law in religious work in our country, so as to solve and resolve the disputes, conflicts and hidden dangers between ethnic and religious communities. In order to improve the level of management of religious affairs in Yunnan Province, the aim of managing religious activities according to law and guaranteeing freedom of religious belief according to law is realized. The first four chapters mainly introduce the topics, the history of Christian communication in Yunnan, the problems in communication and the governance of illegal communication. In the part of introduction, the background and significance of this thesis are explained, and the related domestic and foreign research results are summarized, summarized and summarized. In the first chapter, the causes of Christianity and its historical development are briefly introduced. At the same time, the characteristics and definitions of Christianity are summarized, and the connotation and extension of Christianity studied in this paper are determined. Then the history of Christianity into China is combed, and the historical process of Christianity entering Yunnan and spreading in Yunnan is reviewed. The second chapter focuses on the dissemination of contemporary Christianity in Yunnan and its existing problems. First, it introduces the rise of the "three self Patriotic" movement after the founding of New China. Secondly, the paper studies the influence of religion and Christianity on the life and habits of Yunnan's border and ethnic minorities. Finally, the paper analyzes the prominent problems in the spreading process of Christianity in Yunnan, such as underground churches, family churches and illegal missionary missions on the Internet, so that some missionaries deviate from Christianity "equality and freedom." The extreme religious thought produced by the spirit of fraternity, the hostile forces at home and abroad using religious means to infiltrate China's frontier areas, weaken our national consciousness and national identity, are analyzed. The third chapter, from the angle of religious legalization, studies the legal governance and enlightenment of the spread of Christianity in Yunnan. This paper analyzes the advantages and disadvantages of the religious governance model in the world, introduces and summarizes the foreign religious governance experience, and makes textual research on the laws of the Tang Dynasty, the laws and regulations of the Qing Dynasty and the restrictions of the ROC government on the administration and dissemination of religions. By analyzing the present situation of the legal governance of illegal spread of Christianity in Yunnan Province, we can draw some basic principles which are universal and effective to the governance of religion under the circumstance of the rule of law by religion. The fourth chapter is a summary of the full text, on the basis of the enlightenment of religious rule of law to Yunnan government, the author puts forward some thoughts on perfecting the construction of religious rule of law in China. First of all, it demonstrates the necessity of establishing the system of religious rule of law in our country. Secondly, it discusses how to deal with the relationship between religious rule by law and freedom of belief, and how to deal with the relationship between state policy and national law. Finally, the author puts forward some concrete suggestions such as promoting the legislation of religious science, strengthening the strict law enforcement of religion in China and popularizing the law of the whole people on religious policies and regulations.
