【摘要】：在清代州縣詞訟審斷中,批發(fā)呈詞一直被清代州縣官視為息訟辨奸的重要方式。一方面,州縣官運用批詞處理訟案審斷等的程序性事務(wù)推動訴訟的順利進行;另一方面,州縣官運用批詞對訟案內(nèi)容做出是非判定和實質(zhì)性利益的裁斷。由于批詞主體不同,批詞在形式風格以及內(nèi)容等方面表現(xiàn)出較強的靈活性、差異性等特點。作為清代州縣司法中運用廣泛的法律文書,批詞反映了州縣官對訟案的立場、關(guān)注,同時,批詞也深刻地反映了清代州縣司法的職權(quán)式審斷模式以及訟案審斷的差異化特征。
[Abstract]:In the first instance of prefectural ci in Qing Dynasty, Wholesale word was always regarded as an important way by prefectural magistrate in Qing Dynasty. On the one hand, the state and county officials use approval to deal with procedural matters such as trial and adjudication to promote the smooth progress of the proceedings; on the other hand, the state and county officials use the approval of the content of the case to make a judgment of right and wrong and substantive interests. Because of the different subject of the criticism, the criticism shows strong flexibility and difference in the aspects of style and content. As a widely used legal document in the state and county judicature of the Qing Dynasty, the criticism reflects the position and concern of the state and county officials on the case, and at the same time, it also profoundly reflects the mode of jurisdiction and adjudication of the state and county judicature in the Qing Dynasty, as well as the different characteristics of the trial and adjudication of the case.
