【摘要】：西漢官吏懲治制度是在秦制的基礎上繼承發(fā)展而來的，它對于懲處官吏違法犯罪行為，維護國家各個組織機構(gòu)的正常運轉(zhuǎn)，維護中央皇權(quán)具有重要意義。本文由官吏懲治的視角，從漢初官吏懲治的原因與依據(jù)、官吏懲治方式、影響官吏懲治的因素和懲治效果、官吏懲治的特征和影響等幾方面對西漢初期官吏懲治問題進行系統(tǒng)地、全方位的考察。 首先，考察西漢初期官吏懲治的原因與依據(jù)。西漢初期官吏犯罪包括瀆職罪、擅為罪、賕罪、盜罪、文書犯罪、軍事犯罪、倫理犯罪等方面，本文將其概括為人事關(guān)系問題、職務問題、經(jīng)濟問題、禮法問題四大方面。 其次，對西漢初期官吏懲治方式進行分類概括。漢代官吏懲治方式主要分為行政處罰方式和刑事處罰方式兩種，當然也不排除其它官吏懲治方式。這些官吏懲治方式方法對規(guī)范官吏行為，懲治官吏犯罪都具有重要意義，對后世官吏管理也有重要的借鑒意義。 再次，，揭示影響西漢初期官吏懲治的因素。漢代官吏懲治不是一個孤立的問題，它受到官吏考課、監(jiān)察、司法以及皇帝赦宥和受懲官吏個人因素等其它因素的影響。概括而言，影響西漢初期官吏懲治因素主要包括制度和非制度兩種因素。 最后，在以上研究基礎上，總結(jié)西漢初期官吏懲治的特征與影響。西漢初期官吏懲治特征體現(xiàn)為諸多方面，如以刑律為依據(jù)、手段多樣性、懲治靈活性等。西漢初官吏懲治也產(chǎn)生了積極與消極兩方面的影響，積極影響是主導�？傊�，西漢初期的官吏懲治制度為后世官吏懲治提供了重要范式。
[Abstract]:The punishment system of officials in the Western Han Dynasty was inherited and developed on the basis of Qin Dynasty. It is of great significance to punish the illegal and criminal acts of government officials, to maintain the normal operation of various state organizations and to safeguard the central imperial power.This article from the angle of the official punishment, from the early Han Dynasty official punishment reason and the basis, the official punishment way, the influence official punishment factor and the punishment effect,The characteristics and influence of the punishment of officials in the early Western Han Dynasty were systematically and omni-directionally investigated.First of all, to investigate the reasons and basis of the punishment of officials in the early Western Han Dynasty.The crimes committed by officials in the early Western Han Dynasty included malfeasance crime, misdemeanor crime, crime of theft, clerical crime, military crime, ethical crime and so on.Secondly, it classifies and generalizes the ways of punishing officials in the early Western Han Dynasty.The punishment of officials in Han Dynasty can be divided into two kinds: administrative punishment and criminal punishment.The ways and means of punishing officials are of great significance for standardizing their behavior and punishing their crimes, as well as for the management of officials in later generations.Thirdly, the factors affecting the punishment of officials in the early Western Han Dynasty were revealed.The punishment of officials in Han Dynasty is not an isolated problem, it is influenced by other factors, such as examination, supervision, judicature and personal factors such as forgiveness and punishment by emperors.Generally speaking, the factors influencing the punishment of officials in the early Western Han Dynasty mainly include institutional and non-institutional factors.Finally, on the basis of the above research, the characteristics and influence of official punishment in the early Western Han Dynasty were summarized.In the early Western Han Dynasty, the punishment of officials was characterized by many aspects, such as the criminal law, the variety of means, the flexibility of punishment and so on.The punishment of officials in the early Western Han Dynasty had both positive and negative effects, and the positive influence was dominant.In a word, the system of punishing officials in the early Western Han Dynasty provided an important paradigm for the punishment of officials in later generations.
