完善我國行政問責(zé)制的探討

【摘要】:2003年非典在我國爆發(fā)后,黨中央在抗擊非典的同時也免除了兩位高官的職務(wù),隨后,行政問責(zé)制開始行為行政管理體制改革中的熱門話題。近年來,我國中央黨政機關(guān)和地方政府相繼出臺了一系列有關(guān)行政問責(zé)的條例、辦法和規(guī)定,行政問責(zé)制在我國已經(jīng)開始逐漸的發(fā)展起來,在當(dāng)今社會,行政問責(zé)制的實施已經(jīng)成為建設(shè)責(zé)任政府的重要保障,它既是一個重要的理論問題,又是一個艱巨的社會實踐課題。行政問責(zé)制的實施可以使行政機關(guān)及行政官員明確權(quán)責(zé)關(guān)系,而且還可以促進我國責(zé)任型政府的建設(shè),是從責(zé)任的角度實現(xiàn)對行政權(quán)力的監(jiān)督和制約。深入研究行政問責(zé)機制對于促進我國貫徹落實科學(xué)發(fā)展觀、構(gòu)建社會主義和諧社會、豐富權(quán)力監(jiān)督制約理論等都具有重大的理論和實踐意義。 雖然在我國行政問責(zé)制的實施已經(jīng)取得了一定得成績,但是該制度本身還需要進一步的完善,并且還需要很多外在條件來對行政問責(zé)制加以保障。本文在論述過程中主要應(yīng)用行政問責(zé)基本理論,對當(dāng)前我國行政問責(zé)制在實施過程中所遇到的阻礙進行分析,強調(diào)我國行政問責(zé)制的建立不能脫離我國處于社會主義初級階段的基本國情,并且通過借鑒西方發(fā)達(dá)國國家在行政問責(zé)制實施過程中的積累的經(jīng)驗,結(jié)合我國實際國情,指出目前我國行政問責(zé)制還存在很多問題,諸如問責(zé)主體不明確、問責(zé)客體界定不清、問責(zé)標(biāo)準(zhǔn)不確定、問責(zé)程序不健全以及問責(zé)法律體制不完善等問題。本文強調(diào)構(gòu)建行政問責(zé)機制的目的,是要建立起為人民服務(wù)、真正向人民負(fù)責(zé)的責(zé)任型政府。指出隨著理論研究和實踐發(fā)展的深入,應(yīng)逐步實現(xiàn)從行政問責(zé)機制到公共權(quán)力問責(zé)機制體系,最后對我國完善行政問責(zé)制提出以下構(gòu)想:我國需要在營造問責(zé)制文化、完善相關(guān)法律制度、明確問責(zé)主體、掃除問責(zé)障礙、配套相關(guān)制度形成完整的問責(zé)體系、發(fā)揮廣大人民作用等方面做出努力。
[Abstract]:After SARS broke out in China in 2003, the CPC Central Committee dismissed two senior officials while fighting SARS, and then the administrative accountability system began to be a hot topic in the reform of administrative management system. In recent years, our central party and government organs and local governments have successively issued a series of regulations, methods and regulations on administrative accountability. Administrative accountability system has begun to develop gradually in our country, and in today's society, The implementation of administrative accountability system has become an important guarantee for the construction of responsible government. It is not only an important theoretical issue, but also a difficult social practical subject. The implementation of administrative accountability system can make the relationship between power and responsibility clear for administrative organs and administrative officials, and it can also promote the construction of responsible government in our country, which is to realize the supervision and restriction of administrative power from the angle of responsibility. It is of great theoretical and practical significance to study the mechanism of administrative accountability in order to promote the implementation of the concept of scientific development, build a harmonious socialist society and enrich the theory of power supervision and restriction. Although the implementation of the administrative accountability system in our country has made certain achievements, but the system itself still needs to be further improved, and also needs a lot of external conditions to protect the administrative accountability system. This paper mainly applies the basic theory of administrative accountability to analyze the obstacles encountered in the implementation of administrative accountability system in China. It is emphasized that the establishment of administrative accountability system in our country cannot be divorced from the basic national conditions of our country in the primary stage of socialism, and by drawing lessons from the experience accumulated in the implementation of the administrative accountability system in the developed countries of the West, and combining with the actual conditions of our country, It is pointed out that there are still many problems in China's administrative accountability system, such as unclear accountability subject, unclear definition of accountability object, uncertain accountability standards, imperfect accountability procedures and imperfect legal system of accountability. The purpose of constructing administrative accountability mechanism is to establish a responsible government that serves the people and is responsible to the people. It is pointed out that with the development of theoretical research and practice, we should gradually realize the system from administrative accountability mechanism to public power accountability mechanism. Finally, the author puts forward the following ideas to perfect the administrative accountability system in China: China needs to build an accountability culture. Improve the relevant legal system, clear the subject of accountability, remove the obstacles to accountability, supporting the relevant system to form a complete accountability system, play the role of the broad masses of the people to make efforts.
