【摘要】：當(dāng)代民主建設(shè)主要是以西方經(jīng)驗(yàn)為基礎(chǔ)的制度轉(zhuǎn)型。政治學(xué)借鑒經(jīng)濟(jì)學(xué)和醫(yī)學(xué)研究將這種制度轉(zhuǎn)型稱為"制度進(jìn)口"或"制度移植"。目前西方制度移植研究主要聚焦在被移植國(guó)的制度構(gòu)建上。西方學(xué)者不僅關(guān)注移植西方政治和法律制度的可能性,而且研究制度移入對(duì)象國(guó)的具體形式�，F(xiàn)有西方研究多數(shù)指出民主和憲政是沖突后國(guó)家建設(shè)的核心,不僅有利于民族國(guó)家重建,也有利于與鄰國(guó)建立和平關(guān)系。不過(guò),部分西方學(xué)者指出,小布什政府強(qiáng)行推進(jìn)西方民主踐踏了全世界人民對(duì)民主的信任,損害了美國(guó)作為民主"推進(jìn)者"的形象。美國(guó)應(yīng)該反躬自省,加強(qiáng)國(guó)內(nèi)民主建設(shè)。原蘇東地區(qū)國(guó)家的民主建設(shè)面臨三重挑戰(zhàn),現(xiàn)有研究對(duì)這些挑戰(zhàn)的論述過(guò)于簡(jiǎn)化。后社會(huì)主義國(guó)家制度轉(zhuǎn)型必須考慮"接受國(guó)"的自身特征和歷史傳統(tǒng)。
[Abstract]:Contemporary democratic construction is mainly based on the western experience of institutional transformation. Political science uses economics and medical research for reference to call this institutional transformation "institutional import" or "institutional transplantation". At present, the study of institutional transplantation mainly focuses on the institutional construction of the transplanted countries. Western scholars not only pay attention to the possibility of transplanting western political and legal systems, but also study the specific forms of institutional migration into the target countries. Most of the existing western studies point out that democracy and constitutionalism are the core of the building of a post-conflict state, which is not only conducive to nation-state reconstruction, but also conducive to establishing peaceful relations with neighboring countries. However, some Western scholars point out that the Bush administration has trampled on the people's trust in democracy and damaged the image of the United States as a "promoter" of democracy. The United States should reflect on itself and strengthen democracy at home. The former Soviet Union and Eastern countries face triple challenges to democracy construction, and the existing studies on these challenges are too simplistic. The system transformation of post-socialist countries must take into account the characteristics and historical traditions of the receiving countries.
