【摘要】：機(jī)會(huì)公平是社會(huì)公平的主要內(nèi)容和重要體現(xiàn)。人們常常把機(jī)會(huì)公平等同于程序正義,而忽視了制度的制約因素。近些年來,西方學(xué)者探討了機(jī)會(huì)中的責(zé)任與義務(wù),區(qū)分了可選擇性因素和非選擇性因素影響,提出對(duì)非選擇性因素的影響應(yīng)該補(bǔ)償,而對(duì)可選擇性因素的影響采取應(yīng)得原則。然而,他們?nèi)詻]有深入探討社會(huì)制度對(duì)機(jī)會(huì)公平的影響。只有消滅私有制,實(shí)現(xiàn)公有制,才能真正為機(jī)會(huì)公平創(chuàng)造條件。在社會(huì)主義社會(huì),只有在資格平等的基礎(chǔ)上實(shí)行勞動(dòng)機(jī)會(huì)的公平和共享改革紅利的平等,才是機(jī)會(huì)公平的真正內(nèi)涵。
[Abstract]:Opportunity equity is the main content and important embodiment of social equity. People often equate opportunity justice with procedural justice, but ignore the restriction of system. In recent years, the western scholars have discussed the responsibility and obligation in the opportunity, distinguished the influence of the optional factor from the non-selective factor, and proposed that the influence on the non-selective factor should be compensated, and the due principle should be taken on the influence of the selectable factor. However, they still haven't explored the influence of social system on opportunity equity. Only by eliminating private ownership and realizing public ownership can we truly create conditions for fair opportunity. In socialist society, it is only on the basis of equality of qualifications that the fairness of labor opportunity and the equality of sharing reform dividend are the true connotations of opportunity equity.
