【摘要】：在我國,生態(tài)行政約談制度已呈現(xiàn)多元化實踐樣態(tài),但其理論研究仍主要置于法學以及行政法學的學科視野,定位在追求健全法制和促進法治的實踐目標。生態(tài)行政約談制度作為一種制度創(chuàng)新,與傳統(tǒng)行政方式和法律制度不同,應當展現(xiàn)出面向后工業(yè)社會的新型道德制度曙光,應當順應歷史發(fā)展大趨勢,超越工業(yè)社會的協(xié)作社會制度,構(gòu)建面向后工業(yè)社會以新型合作社會制度為其本質(zhì)內(nèi)容的道德制度。因此,應賦予生態(tài)行政約談制度更為豐富和深刻的新內(nèi)容、新地位與新功能。當然這也將是一個深刻變革和長期發(fā)展的歷史過程。
[Abstract]:In our country, the system of ecological administrative interview has taken on a diversified pattern of practice, but its theoretical research is still mainly placed in the field of view of law and administrative law, and its orientation is to pursue the practical goal of perfecting the legal system and promoting the rule of law. As a kind of system innovation, the ecological administrative interview system is different from the traditional administrative mode and the legal system. It should show the dawn of the new moral system in the post-industrial society and conform to the trend of historical development. To transcend the cooperative social system of industrial society and construct the moral system of the post-industrial society with the new cooperative social system as its essential content. Therefore, the ecological administrative interview system should be endowed with more abundant and profound new contents, new status and new functions. Of course, this will also be a profound change and long-term development of the historical process.
