【摘要】：作為現(xiàn)代社會(huì)貫穿始終的核心環(huán)節(jié),權(quán)利的斷裂與修復(fù)伴隨著政治發(fā)展的全部過程。從財(cái)產(chǎn)權(quán)到自由權(quán),從雅典的國(guó)家本位到近代資本主義的崛起,權(quán)利日益具備了國(guó)家、個(gè)體到社會(huì)的多重轉(zhuǎn)型的內(nèi)容。國(guó)家主義時(shí)期伴隨著國(guó)家與個(gè)體的權(quán)利一致;在市場(chǎng)體系建立之后,則體現(xiàn)為個(gè)體權(quán)利對(duì)于國(guó)家整體的否定。在國(guó)家與社會(huì)分離之后,權(quán)利與公共利益的耦合又成為公共治理發(fā)展的重要內(nèi)容。因此,承認(rèn)權(quán)利平等是政治平等的前提,并吻合了民主政治的基本價(jià)值,國(guó)家、社會(huì)乃至市場(chǎng)力量共同參與的公共治理因此成為自由政治實(shí)現(xiàn)的途徑。
[Abstract]:As the core link throughout the modern society, the breakage and restoration of rights are accompanied by the whole process of political development. From property right to liberty, from the state standard of Athens to the rise of modern capitalism, the rights increasingly have the content of state, individual and society. In the period of nationalism, the rights of the state and the individual are consistent; after the establishment of the market system, it is embodied in the negation of the individual right to the state as a whole. After the separation of state and society, the coupling of rights and public interests has become an important content of public governance. Therefore, the recognition of equality of rights is the premise of political equality, and accords with the basic value of democratic politics. Therefore, the public governance in which the state, society and market forces participate together becomes the way to realize the free politics.
