【摘要】：歷史能在多大程度上賦予統(tǒng)治以合法性,這一普遍問題在柏克"因襲"學(xué)說中有精妙回答。其精妙性有賴于"因襲"在普通法上的雙重含義和英國(guó)法政傳統(tǒng)的兩種因襲主義所提供的空間。柏克之說是對(duì)二元因素的糅合。結(jié)合語(yǔ)境和文本,大致可識(shí)別出他為克服張力所采用的修辭手法。由此,他樹立歷史的權(quán)威,卻否認(rèn)歷史可被用作否定當(dāng)下的外在標(biāo)尺;確認(rèn)當(dāng)下的權(quán)威,卻否認(rèn)當(dāng)下可與歷史決裂。其目的在于平衡道統(tǒng)與今王、自由與權(quán)威、革命與反革命。其根本教益是用時(shí)間的調(diào)和性馴化政治主體及其訴求的絕對(duì)性,使政治變得有彈性,使張力變得有意義。
[Abstract]:The general question of the extent to which history gives legitimacy to rule is well answered in Burke's theory of inheritance. Its subtlety depends on the double meaning of "inheritance" in common law and the space provided by the two kinds of inheritance in the tradition of English law. Burke's theory is a mixture of duality. In combination with context and text, the rhetorical devices used by him to overcome tension can be roughly recognized. Therefore, he establishes the authority of history, but denies that history can be used as the external yardstick of negating the present; he confirms the authority of the present, but denies that the present can break away from history. Its purpose is to balance the Taoism and the present king, freedom and authority, revolution and counter-revolution. The fundamental lesson is to acclimatize the political subject and its demands with time, so that politics becomes flexible and tension becomes meaningful.
