【摘要】："政黨法制"是二戰(zhàn)后政黨政治的新現(xiàn)象、新趨勢(shì),其主要價(jià)值追求在于維護(hù)政黨政治秩序與政治穩(wěn)定。戰(zhàn)后世界政黨法制的內(nèi)容主要包括政黨地位與政黨行為,但政黨行為法制化具有不完善的特點(diǎn)。總的說(shuō)來(lái),戰(zhàn)后世界政黨法制有利于維護(hù)政黨政治秩序,具有一定的歷史進(jìn)步性與現(xiàn)實(shí)合理性;但相對(duì)于政黨政治、民主政治發(fā)展而言,政黨法制存在一定的政治局限性,這是由政黨政治與法律的自身特點(diǎn)、政黨法制的政治性、政黨政治的利益性等決定的。當(dāng)代政黨政治的復(fù)雜性決定了,單靠法律無(wú)法有效促進(jìn)民主政治發(fā)展,只有政黨法律規(guī)范、社會(huì)規(guī)范、內(nèi)部規(guī)范協(xié)同作用,方利于政黨政治之序與民主政治發(fā)展。
[Abstract]:Party legal system is a new phenomenon and trend of party politics after World War II, whose main value is to maintain political order and political stability. After the war, the content of political party legal system in the world mainly includes party status and party behavior, but the legalization of party behavior is imperfect. Generally speaking, the political party legal system in the postwar world is conducive to the maintenance of party political order and has a certain historical progress and realistic rationality. However, compared with the political party politics and the development of democratic politics, the political party legal system has certain political limitations. This is determined by the characteristics of political party politics and law, the political nature of party legal system, the interest of party politics, etc. The complexity of contemporary party politics determines that law alone can not effectively promote the development of democratic politics, only the coordination of party legal norms, social norms and internal norms can benefit the order of party politics and the development of democratic politics.
