【摘要】：在公共行政學領域,自由裁量權作為橫跨行政法學與組織社會學的交叉學科,對其的研究可謂繁多。從法學的角度而言,自由裁量的研究多聚焦于對于裁量的概念,現(xiàn)狀分析以及如何控制等問題的探討。不過與在法制角度對自由裁量關注不同,組織社會學的研究者則是關注于組織內部復雜的政治與社會過程,包括成員的動機、信念與態(tài)度等因素加諸裁量行為的影響。處在政治體系中政策傳導末端的基層官僚擁有相當大的自由裁量權,但對于其自由裁量權的研究,在我國現(xiàn)在的研究成果中,從法學角度而言,一般是通過從法律法規(guī)入手,控制基層官僚的自由裁量權作為研究重點；從公共行政角度而言,一般是從組織激勵的角度入手,對基層官僚的自由裁量權進行研究分析。然而,對于基層官僚在行政執(zhí)法的過程中,究竟是何種因素影響著基層官僚的自由裁量權,這方面的研究,卻不多見。 因此,本文將以基層官僚理論(也稱街頭官僚理論)為基礎,對基層官僚自由裁量權的影響因素加以分析�；鶎庸倭抛鳛檎邆鲗У哪┒�,不僅僅是政策的執(zhí)行者,還因為手中相當大的自由裁量權,在一定程度上,實質成為了政策的制定者。對于基層官僚自由裁量權影響因素的研究離不開基層官僚的工作系統(tǒng),所以對于基層官僚的自由裁量權的研究,本文以基層官僚的工作系統(tǒng)環(huán)境入手,從基層官僚組織、基層官僚的當事人以及基層官僚自身三方面來研究基層官僚的自由裁量權,并指出基層官僚因工作需要發(fā)展出的例行慣例也一定程度影響基層官僚的自由裁量權。全文由六部分組成：第一章導論部分,主要闡述本文的研究背景、研究意義、研究方法以及相關的文獻綜述；第二章為基層官僚理論,主要闡述了涉及本文有關基層官僚自由裁量權的概念和理論基礎；第三章主要從基層官僚工作系統(tǒng)方面闡述了基層官僚自由裁量權的影響因素；第四章則是指出基層官僚的工作慣例模式同樣成為影響基層官僚自由裁量權的一個重要因素；第五章則是對基層官僚自由裁量改革的設想；第六章則是結語。
[Abstract]:In the field of public administration, discretion is a cross-discipline of administrative law and organizational sociology. From the point of view of law, the study of discretion focuses on the concept of discretion, current situation analysis and how to control it. However, the researchers of organizational sociology focus on the complicated political and social processes of the organization, including the motivation, belief and attitude of the members, and the influence of discretion behavior. The grass-roots bureaucrats who are at the end of the policy transmission in the political system have considerable discretion, but the research on the discretion of the bureaucrats in our country now, from the perspective of law, is generally through the beginning of laws and regulations. From the perspective of public administration, it is generally from the perspective of organizational incentives to study and analyze the discretion of grass-roots bureaucrats. However, there are few studies on what factors affect the discretion of the grass-roots bureaucrats in the process of administrative law enforcement. Therefore, based on the grass-roots bureaucracy theory (also called street bureaucracy theory), this paper analyzes the influencing factors of the discretion of grass-roots bureaucrats. As the end of policy transmission, grass-roots bureaucrats are not only the executors of policies, but also because of their considerable discretion, to a certain extent, the essence has become the policy makers. The study of the influencing factors of the discretionary power of the grass-roots bureaucrats can not be separated from the work system of the grass-roots bureaucrats. Therefore, the study of the discretionary power of the grass-roots bureaucrats is based on the working system environment of the grass-roots bureaucrats, starting with the grass-roots bureaucrats' organizations. The parties of the grass-roots bureaucrats and the grass-roots bureaucrats themselves study the discretion of the grass-roots bureaucrats, and point out that the routine rules developed by the grass-roots bureaucrats because of their work needs also affect the discretion of the grass-roots bureaucrats to a certain extent. The full text is composed of six parts: the first chapter is the introduction, which mainly describes the research background, research significance, research methods and related literature review; the second chapter is the grass-roots bureaucracy theory. This paper mainly expounds the concept and theoretical basis of the discretion of the grass-roots bureaucrats, the third chapter mainly expounds the influencing factors of the discretion of the bureaucrats at the grass-roots level from the aspect of the bureaucratic work system at the grass-roots level. The fourth chapter points out that the mode of working practice of the grass-roots bureaucrats has also become an important factor affecting the discretion of the grass-roots bureaucrats; the fifth chapter is the assumption of the reform of the discretion of the grass-roots bureaucrats; the sixth chapter is the conclusion.
