【摘要】：自文藝復(fù)興之后,尤其是工業(yè)革命以來,政治文明有了高度發(fā)展,政治思想沖破了神學(xué)的桎梏,“主權(quán)在民”意識得以最終確立。政府的歸屬性問題成為其尋求合法性的根源。公共行政的公正追求源自于公共權(quán)力的公共性質(zhì)。公共性作為公共行政最本質(zhì)最核心的價值最終極的意義正是在于保證公共行政不偏離公共軌道,不偏離公共利益的方向。然而社會在其運(yùn)行中卻存在著各種各樣有組織的利益訴求,現(xiàn)實(shí)中嚴(yán)重的執(zhí)法犯法、徇私枉法、權(quán)錢交易等腐敗現(xiàn)象,以及推諉扯皮、辦事拖拉等官僚主義屢見不鮮,究其根源,無礙乎當(dāng)下公共性的普遍缺失。因此,重構(gòu)公共行政之公共性便成了當(dāng)務(wù)之急。 本文將公共行政價值之公共性作為研究對象,意在通過分析公共行政公共性得以最終形成和確立的理論歷程以及現(xiàn)實(shí)中公共行政公共性異化及普遍缺失的深層次原因,提出重構(gòu)公共行政價值之公共性之道。 本文首先從政治發(fā)展史的角度闡釋并剖析了公共行政公共性的理論溯源以及公共性論證得以最終完成和確立的發(fā)展路徑。其間有三個發(fā)展階段,即古希臘古羅馬時期從柏拉圖、亞里士多德的城邦制到西塞羅的共和國,自文藝復(fù)興以后從洛克的自由主義、盧梭的人民主權(quán)到密爾的代議制政府以及發(fā)展到近現(xiàn)代從約翰·羅爾斯的正義論到漢娜·阿倫特和哈貝馬斯的公共領(lǐng)域及公共性的缺失。接下來從公共領(lǐng)域的異化和政府的自利性兩個維度分析公共性普遍缺失的深層次原因。公共利益雖然在界定上有其困境,但作為公共的福祉,對公共利益的保護(hù)無疑是重構(gòu)公共性的依歸。公共精神,即為一種關(guān)心公共利益、自主自愿參與公共事務(wù)的精神,公共精神的培育為公共性的重構(gòu)構(gòu)建了一條路徑選擇。本文在對公共精神進(jìn)行解析的基礎(chǔ)上,提出了培育公共精神的幾條途徑,即公共領(lǐng)域的培育,公共教育的發(fā)展,制度安排的創(chuàng)新,及公務(wù)員公共行政精神的重塑。 本文采取科學(xué)主義與人文主義相結(jié)合的方法論,綜合應(yīng)用文獻(xiàn)分析法和歷史研究法。通過文獻(xiàn)分析法,找出各個理論關(guān)注的不同側(cè)面及相互之間的邏輯關(guān)系,以支撐自己的論題。通過歷史研究法研究公共性理論的發(fā)展脈絡(luò),找出其間的因果轉(zhuǎn)承,演繹出公共性缺失的原因,提出重構(gòu)公共行政價值之公共性之道。
[Abstract]:Since the Renaissance , especially since the industrial revolution , the political civilization has developed highly , the political thought has broken the shackles of theology , and the consciousness of " sovereign people " has become the root cause of its legitimacy . Public administration is the most essential value of public administration . Public administration is the most essential value of public administration . Public administration is the most essential value of public administration .

In this paper , the public nature of the value of public administration is regarded as the research object , which is intended to put forward the public road of reconstructing the value of public administration by analyzing the theoretical course of the final formation and establishment of the public administration and the deep reason of the public alienation and the general lack of public administration in reality .

From the perspective of the history of political development , this paper expounds and analyzes the theoretical origin of public administration and the development path that the public demonstration is finally completed and established . There are three stages of development , namely , the ancient Greek ancient Rome period from Plato , Aristotle ' s city state to the Republic of Cicero . The public spirit , namely , the public interest , the autonomy of the people ' s autonomy to the public affairs , the cultivation of the public spirit is a path choice . In this paper , we put forward several ways to cultivate public spirit , namely , the cultivation of public domain , the development of public education , the innovation of institutional arrangement and the remodeling of public administration spirit of civil servants .

Based on the methodology of combining scientism and humanism , this paper comprehensively applies the literature analysis method and the historical research method . Through the literature analysis method , we find out the different side of each theory concern and the logical relation between each other , so as to support his thesis . Through the history research method , we study the development of the public theory , find out the cause of the lack of public property , and put forward the public road to reconstruct the value of public administration .
