反歧視的理論依據(jù)及對(duì)策完善

【摘要】: 非歧視是人權(quán)的核心概念之一,《人權(quán)宣言》30章中有26章始于“人人”、“任何人”這樣的字眼,人人應(yīng)享有人權(quán),任何人不能被排除在外;人類生而自由,平等享有尊嚴(yán)與權(quán)利;非歧視必須得到伸張。正如聯(lián)合國(guó)人權(quán)事務(wù)高級(jí)專員納維?皮萊所言,“歧視是世界上很多最緊迫的人權(quán)問(wèn)題的根源。沒(méi)有哪一個(gè)國(guó)家能幸免于此,消除歧視是最高秩序的責(zé)任”。因此,“倡導(dǎo)多元、消除歧視”成為2009年世界人權(quán)日的官方主題。在現(xiàn)代法治國(guó)家,對(duì)反歧視進(jìn)行理論分析,并將消除歧視納入法治視野是十分迫切和必要的。本文從法理學(xué)的角度,分析反歧視的原因和意義,并在理論分析基礎(chǔ)上結(jié)合實(shí)踐尋求消除歧視的法律對(duì)策。 本文除引言和結(jié)語(yǔ)外,共分為三個(gè)部分。第一部分回答本文所研究的歧視“是什么”,闡述歧視的定義、分類和例外,并對(duì)反歧視的主要國(guó)際法淵源和國(guó)內(nèi)法淵源進(jìn)行梳理。對(duì)國(guó)際法淵源的梳理使反歧視有明確的努力方向;對(duì)國(guó)內(nèi)法淵源的梳理使反歧視對(duì)策分析跟貼近實(shí)際情況。第二部分主要研究“為什么”要反歧視,比較全面地從人的尊嚴(yán)、平等權(quán)利、社會(huì)效益及政府責(zé)任和個(gè)人義務(wù)等幾個(gè)角度進(jìn)行分析。第三部分主要研究“怎么樣”反歧視,在前面兩部分的基礎(chǔ)上,結(jié)合中國(guó)的現(xiàn)實(shí)國(guó)情,從法律的視角比較系統(tǒng)地按照立法、司法和政策三個(gè)維度提出相應(yīng)對(duì)策。
[Abstract]:Non-discrimination is one of the core concepts of human rights. In chapter 30 of the Declaration of Human Rights, 26 chapters begin with the words "everyone" and "any person". Everyone should enjoy human rights, and no one can be excluded; human beings are born free, Equal dignity and rights; non-discrimination must be upheld. Like the United Nations High Commissioner for Human Rights, Navi? Discrimination is the root cause of many of the world's most pressing human rights problems. No country is immune from this, and the elimination of discrimination is the responsibility of the highest order. " Thus, promoting pluralism and eliminating discrimination became the official theme of World Human Rights Day 2009. In modern countries ruled by law, it is urgent and necessary to analyze the theory of anti-discrimination and to bring the elimination of discrimination into the vision of rule of law. From the perspective of jurisprudence, this paper analyzes the reasons and significance of anti-discrimination, and on the basis of theoretical analysis, seeks legal countermeasures to eliminate discrimination. In addition to the introduction and conclusion, this article is divided into three parts. The first part explains the definition, classification and exception of discrimination, and combs the main sources of international law and domestic law of discrimination. The combing of the sources of international law makes the direction of anti-discrimination clear, and the combing of the sources of domestic law makes the countermeasures of anti-discrimination close to the actual situation. The second part mainly studies "why" to fight against discrimination, comparatively comprehensively carries on the analysis from the human dignity, the equal right, the social benefit and the government responsibility and the individual duty and so on several angles and so on. The third part mainly studies "how to" the anti-discrimination, on the basis of the first two parts, unifies the reality situation of China, from the legal angle of view more systematically according to the legislation, the judicature and the policy three dimensions proposes the corresponding countermeasure.
