【摘要】：人權(quán)是人類具有理性思維之后的選擇性產(chǎn)物,人權(quán)的發(fā)展以理性為主軸而形成相對完整的人權(quán)之鏈。進(jìn)入現(xiàn)代以后,隨著市場經(jīng)濟(jì)的高度自主化和經(jīng)濟(jì)全球化的頻繁交涉,理性軸承功能逐漸消退,人權(quán)發(fā)展的理性圖景呈現(xiàn)出模糊性情境。為此需要超越傳統(tǒng)抽象理性假定思維模式,通過實踐性和關(guān)系性的商談理性達(dá)成理性基礎(chǔ)上的人權(quán)系譜共識,并通過自治論據(jù)、共識論據(jù)與民主論據(jù)等予以證成和推進(jìn),以達(dá)致破解現(xiàn)代人權(quán)迷途理性之策。
[Abstract]:Human rights are the selective products of human beings with rational thinking. The development of human rights takes reason as the main axis and forms a relatively complete chain of human rights. After entering the modern era, with the highly autonomous nature of the market economy and the frequent negotiations of economic globalization, The rational bearing function gradually disappears, and the rational picture of human rights development presents a fuzzy situation. Therefore, it is necessary to transcend the traditional thinking mode of abstract rationality and reach the consensus of human rights pedigree on the basis of rationality through practical and relational negotiation rationality. And through the autonomy argument, consensus argument and democratic argument to prove and promote, in order to solve the modern human rights misguided rational strategy.
