先秦儒學責任政治的現(xiàn)代法治意涵

【摘要】:先秦儒學的責任政治以"五倫"為基礎,認為人與人之間是由情感聯(lián)系在一起的,親情則是所有情感的原點;社會關(guān)系就是將親情依著血緣關(guān)系的親疏遠近逐漸擴及他人,并以此為紐帶形成人際關(guān)系的外擴結(jié)構(gòu),以"仁政"為內(nèi)涵的責任政治就是要培養(yǎng)并維護這種社會關(guān)系。其生發(fā)邏輯包含積極向善的人性觀和合宜關(guān)系的社會理想兩個方面,運行邏輯包含修身為政和以民為本兩個方面。從責任倫理平衡權(quán)利話語、主體間性緩和理性獨白、平等對話取代單方標準等三個層面理解先秦儒學責任政治的法治面向,對于把握中國現(xiàn)代法治精神中的自主性和適應性,進而建構(gòu)法治的中國話語體系具有重要意義。
[Abstract]:The responsibility politics of Confucianism in Pre-Qin Dynasty is based on "five Lun", which holds that people are connected by emotion, and kinship is the origin of all emotions. The responsibility politics with the connotation of "benevolent government" is to cultivate and maintain this kind of social relationship. The logic of its birth and development includes two aspects: the positive view of good human nature and the social ideal of suitable relationship. The operational logic includes two aspects: self-cultivation and people-oriented. From the three aspects of balance of right discourse of responsibility ethics, inter-subjectivity relaxation of rational monologue, equal dialogue replacing unilateral standards, the author understands the legal orientation of the responsibility politics of Confucianism in the pre-Qin period. It is of great significance to grasp the autonomy and adaptability in the spirit of Chinese modern rule of law, and then to construct the Chinese discourse system of rule of law.
