【摘要】： “認真對待權利”,是德沃金給予人們的有益真理,在18世紀歐美革命時期,有一位杰出的思想家同樣以十分認真的態(tài)度,思考了人類普遍權利問題,為追求普遍人權發(fā)出了吶喊,其權利觀給人們留下了十分深刻的印象,他就是潘恩。潘恩認真對待權利問題,與他所處的時代有著密切聯(lián)系。他在英國痛苦的生活遭遇,以及君主制下人們不幸的生存狀態(tài),都促使他積極思考普遍人權問題。柏克對法國大革命人權原則的抨擊,更加促使他決心對人權理論進行總結和梳理。啟蒙思想尤其是啟蒙理性的思維原則,給予了潘恩重要的思維啟示,平等派自由理念、教友派道德教化也給予了潘恩豐富的思想養(yǎng)料。一部《人權論》呼之欲出,在權利觀念史上閃耀著思想光芒。 潘恩構筑了完整的權利觀體系,他對權利概念做出了界定,劃分了天賦權利與公民權利作為權利的兩種不同形式;他的權利觀體系包括了自由權、平等權、幸福權、人民主權等權利具體內容;民主平等的權利特征是他區(qū)別于柏克權利觀的顯著特點。潘恩權利觀的特色在于提出了尋求權利實現(xiàn)的路徑,要求權利理論的實踐。建立代議制民主共和國的政體,是實現(xiàn)普遍人權的政制保障;實行社會福利計劃,進行經(jīng)濟改革,是實現(xiàn)普遍人權的現(xiàn)實救濟。潘恩的權利觀求證于理論,探索于實踐,順乎于理性,順勢于時代,促動了人們權利意識的自覺,推動著革命時代權利話語的主題凸顯,是極其寶貴的思想財富。 作為那個時代的“公共人物”,潘恩的權利觀對歐美世界產生了極其重要的影響。它引領了英國政治思想的革新,促進了英國激進民主思想的發(fā)展;促進了美國一種民主平等政治傳統(tǒng)的形成,推動了普遍人權的擴展。毋庸質疑,潘恩的權利觀是近代人權思想發(fā)展史上的重要一環(huán),對近代人權的發(fā)展與進步有著舉足輕重的作用。 潘恩自覺地做出了那個時代最強烈的公共“吶喊”——對人權的追求,這種“公共吶喊”精神對于我們今天的社會仍有著重要的意義�？季颗硕鞯臋嗬^,其權利理論無論對于潘恩的政治思想研究還是我們今天人權的探討都是有著重要的理論價值,筆者深感這一思想研究

He is Paine Paine, who takes the issue of rights seriously and has a close connection with his time. He has suffered from his painful life in England, And the unfortunate state of existence of the people under the monarchy has prompted him to think positively about universal human rights. Burke's attack on the principles of human rights in the French Revolution, He was even more determined to sum up and sort out the theory of human rights.
