【摘要】：從威爾遜公開(kāi)發(fā)表《行政學(xué)研究》以后,從行政管理被作為一門獨(dú)立學(xué)科提上學(xué)術(shù)高度以來(lái),行政責(zé)任理論的發(fā)展一直伴隨著行政管理學(xué)科的發(fā)展正在慢慢演變。本文的寫作也是針對(duì)這樣的發(fā)展進(jìn)程進(jìn)行研究,主要對(duì)西方思想史中的從卡爾·弗里德里克到羅伯特·登哈特的這段時(shí)期里的行政責(zé)任理論進(jìn)行歷史性的探究。 從卡爾·弗里德里克到羅伯特·登哈特的這段時(shí)期經(jīng)歷了傳統(tǒng)公共行政理論的衰敗時(shí)期,新公共管理理論從萌芽到興盛時(shí)期,以及新公共管理理論逐漸顯露缺陷試圖尋求新的替代模式的時(shí)期。因此也可以說(shuō)這段時(shí)期的行政責(zé)任理論的演變就是新公共管理運(yùn)動(dòng)發(fā)展的一個(gè)縮影。本文對(duì)這段時(shí)期的行政責(zé)任觀的研究的目的,是從對(duì)本文所討論的幾位學(xué)者的行政責(zé)任觀中探析出責(zé)任的理論本質(zhì),以及它的基本價(jià)值訴求,以及對(duì)行政管理發(fā)展具有的借鑒意義。全文按照時(shí)間的推移和理論探討的進(jìn)展展開(kāi),通過(guò)以各個(gè)理論觀點(diǎn)產(chǎn)生的理論背景和基礎(chǔ)為研究依托,伴隨著對(duì)國(guó)內(nèi)外研究思想的歷史演變的探析,深刻的剖析各個(gè)理論觀點(diǎn)本身的特點(diǎn),并對(duì)各個(gè)理論觀點(diǎn)進(jìn)行全面的評(píng)價(jià)。 本文首先介紹卡爾·弗里德里克與赫爾曼·芬納那一場(chǎng)具有歷史性里程碑意義的責(zé)任問(wèn)題的爭(zhēng)論。在這場(chǎng)爭(zhēng)論中弗里德里克先拋出自己的觀點(diǎn),展現(xiàn)了對(duì)主觀責(zé)任控制的偏好,芬納隨即針對(duì)弗里德里克的觀點(diǎn)拿出自己的理由進(jìn)行反駁。在兩人之間通過(guò)文章你來(lái)我往的這樣一種爭(zhēng)論中,我們發(fā)現(xiàn)他們探討的一個(gè)根本性的問(wèn)題就是主客觀責(zé)任控制孰輕孰重的問(wèn)題。接下來(lái),本文針對(duì)這一問(wèn)題被具體拋出后各個(gè)學(xué)者的反應(yīng),漸進(jìn)式的結(jié)構(gòu)性的探究三個(gè)具有代表性的觀點(diǎn)。這三個(gè)觀點(diǎn)都是努力的想在行政責(zé)任客觀本性和主觀本性之間尋得一個(gè)平衡：馬歇爾·迪莫克的主客觀責(zé)任控制平衡；特里·庫(kù)珀嘗試著將倫理道德作為兩者之間的平衡點(diǎn)；而巴巴拉·羅姆澤克則干脆根據(jù)責(zé)任內(nèi)在的外在的以及呈現(xiàn)的個(gè)人自主性高低的特征分類出四種責(zé)任。隨著平衡的難以求得,責(zé)任的復(fù)雜性可見(jiàn)一斑,本文在此基礎(chǔ)上轉(zhuǎn)而探討登哈特提出的責(zé)任并不簡(jiǎn)單的責(zé)任復(fù)雜性觀點(diǎn),從理論基礎(chǔ)到對(duì)以往行政責(zé)任觀的反思,再到登哈特責(zé)任復(fù)雜性的理論內(nèi)在具體責(zé)任觀的構(gòu)建,展現(xiàn)了登哈特的在新公共服務(wù)指導(dǎo)下的行政責(zé)任觀是行政管理理論發(fā)展到現(xiàn)在的產(chǎn)物,順應(yīng)著時(shí)代需要的發(fā)展。最后,通過(guò)對(duì)這段特殊時(shí)期的行政責(zé)任理論的探討研究,對(duì)這樣一個(gè)思想發(fā)展的過(guò)進(jìn)行客觀的分析,挖掘出實(shí)際的演變內(nèi)涵,基本的價(jià)值訴求,值得借鑒的創(chuàng)新之處。
[Abstract]:Since the publication of "Administrative Studies" by Wilson, and since the administration has been raised to the academic level as an independent discipline, The development of the theory of administrative responsibility has been accompanied by the development of the subject of administration is slowly evolving. The historical exploration of the theory of administrative responsibility from Karl Friedrich to Robert Denhardt in the history of Western thought. The period from Carl Friedrich to Robert Denhardt went through a period of decline in the traditional theory of public administration, and the theory of new public management went from the bud to the boom. Therefore, the evolution of the theory of administrative responsibility in this period is a microcosm of the development of the movement of new public management. The purpose of the research on the concept of administrative responsibility in a period of time, It is from several scholars' view of administrative responsibility discussed in this paper to analyze the theoretical essence of responsibility and its basic value demand. According to the passage of time and the progress of theoretical discussion, the thesis is based on the theoretical background and foundation of various theoretical viewpoints. With the analysis of the historical evolution of domestic and foreign research ideas, the characteristics of each theoretical point of view are deeply analyzed, and the comprehensive evaluation of each theoretical point of view. This article begins with a historical landmark debate on responsibility between Carl Friedrich and Helmand Finner, in which Friedrich first throws out his point of view. Showing a preference for subjective control of responsibility, Finner then rebutted his arguments against Frederick's point of view. In such an argument between the two men, We find that one of the fundamental issues they are discussing is the question of which is the priority of subjective and objective responsibility control. Next, this paper deals with the reaction of various scholars after this question has been concretely thrown out. The gradual structural exploration of three representative points of view is an effort to strike a balance between the objective nature of administrative responsibility and the subjective nature: the balance of subjective and objective responsibility control by Matthew Dimoch; Terry Cooper is trying to balance ethics with ethics; Barbara Romzek categorizes four kinds of responsibilities simply according to the internal and external characteristics of responsibility and the level of personal autonomy that is present, and as the balance becomes difficult to achieve, the complexity of the responsibility is evident. On this basis, this paper discusses the complexity of responsibility put forward by Denhart, from the theoretical basis to the reflection of the previous concept of administrative responsibility, and then to the construction of the theory of the complexity of the responsibility of Denhart. It shows that Denhart's concept of administrative responsibility under the guidance of the new public service is the product of the development of administrative management theory to the present and conforms to the needs of the times. Finally, through the study of the theory of administrative responsibility in this special period, Through the objective analysis of the development of such a thought, the author excavates the connotation of the actual evolution, the basic value demand, and the innovation worthy of reference.
