【摘要】：諾齊克從個(gè)人權(quán)利出發(fā),提出了最低限度國(guó)家理論,并認(rèn)為這個(gè)最低限度國(guó)家才是最好的國(guó)家,才能更好的實(shí)現(xiàn)個(gè)人自由,保護(hù)個(gè)人權(quán)利。他立足于市場(chǎng)經(jīng)濟(jì)下,堅(jiān)決捍衛(wèi)個(gè)人權(quán)力,防止政府權(quán)力的過(guò)度擴(kuò)張對(duì)個(gè)人權(quán)利的侵害。對(duì)諾齊克的個(gè)人權(quán)利的相關(guān)思想進(jìn)行研究,對(duì)當(dāng)前全面深化改革時(shí)期的中國(guó)社會(huì)建設(shè)卻有著重要的借鑒意義。十八大、十八屆四中全會(huì)、十八屆五中全會(huì)后,我國(guó)不斷推進(jìn)全面依法治國(guó)戰(zhàn)略,規(guī)范政府權(quán)力,越來(lái)越重視個(gè)人權(quán)利和加大對(duì)個(gè)人權(quán)利的保護(hù)力度。另外諾齊克的最低限度國(guó)家理論對(duì)我國(guó)不斷提高治理能力的現(xiàn)代化也有著重要的啟示作用。本文擬從以下三個(gè)部分展開對(duì)諾齊克的國(guó)家和個(gè)人權(quán)利思想的研究:第一部分?jǐn)M對(duì)諾齊克國(guó)家和個(gè)人權(quán)利思想形成的背景進(jìn)行分析,以探究諾齊克相關(guān)思想得以形成的社會(huì)根源。第二部分?jǐn)M從諾齊克最低限度國(guó)家、個(gè)人權(quán)利,及對(duì)羅爾斯的批判等具體思想內(nèi)容的討論,解析諾齊克關(guān)于國(guó)家和個(gè)人權(quán)利思想的精神內(nèi)核。第三部分?jǐn)M通過(guò)對(duì)諾齊克國(guó)家和個(gè)人權(quán)利思想的評(píng)析,結(jié)合我國(guó)當(dāng)前的現(xiàn)實(shí)國(guó)情,批判地借鑒諾齊克思想的積極因素,為不斷提高我國(guó)政府的有效治理能力,提供可供借鑒的參考意見。
[Abstract]:Nozick from the individual rights, put forward the minimum state theory, and think that this minimum state is the best country, in order to achieve better individual freedom. Based on the market economy, he firmly defended individual power and prevented the excessive expansion of government power from encroaching on individual rights. He studied Nozick's personal rights. However, it is of great significance for the construction of Chinese society in the period of comprehensive reform. After the 18 Congress, the 18 fourth Plenary session and the 18 Fifth Plenary session of the CPC Central Committee, our country has been pushing forward the strategy of ruling the country according to law in an all-round way. Regulate government power. More and more attention has been paid to individual rights and the protection of individual rights has been strengthened. In addition, Nozick's minimum state theory also has an important enlightening effect on the modernization of China's governance capacity. In this part, the author studies Nozick's ideas of state and individual rights. The first part is to analyze the background of the formation of Nozick's thoughts on state and individual rights. In order to explore the social roots of Nozick's related thoughts, the second part is to discuss the specific ideological content of Nozick's minimum state, individual rights, and criticism of Rawls. The third part is to analyze Nozick's thoughts on state and individual rights and to combine the current situation of our country with the analysis of Nozick's thought of state and individual rights. Using the positive factors of Nozick's thought critically for reference can be used for reference in order to continuously improve the effective governance ability of our government.
