【摘要】：中國笞刑、杖刑歷史極為久遠。從遠古的笞、杖、鞭不分，到鞭刑的廢除，這兩種刑罰一直在發(fā)生變化。及至隋唐，笞刑、杖刑正式列為五刑，被記錄在當(dāng)朝法典中，成為和徒刑、流刑、死刑同樣重要的正刑。作為封建五刑的笞刑和杖刑，在唐代的刑罰體系中發(fā)揮著重要的作用。對唐代笞刑、杖刑進行研究，不僅能夠了解這兩種身體刑在唐代律法中的運作情況，，也可以根據(jù)笞刑、杖刑在實際運作中出現(xiàn)的各種新變化來窺視唐后期導(dǎo)致社會法制出現(xiàn)混亂的原因。本文從笞刑、杖刑的淵源及流變、唐代笞刑、杖刑的刑律規(guī)定、唐代笞刑、杖刑的具體實施情況以及唐代笞刑、杖刑制度出現(xiàn)的新變化這四個部分出發(fā)對笞刑、杖刑進行了分析。 第一部分主要論述了，從堯舜時期至唐這幾千年里，笞刑、杖刑的歷史淵源及其流變，目的是從宏觀上掌握笞刑、杖刑的產(chǎn)生和發(fā)展情況。 第二部分對唐代笞刑、杖刑的刑律規(guī)定作了一個總述。包括笞刑、杖刑的刑罰等級，笞刑、杖刑的刑具，適用笞刑、杖刑的犯罪罪名，笞刑、杖刑的執(zhí)行方式，杖刑在特定情況下可以代替徒刑和流刑，以及對更犯的懲處這六項內(nèi)容做出總結(jié)與分析。從中可以對唐律中關(guān)于笞刑、杖刑的相關(guān)內(nèi)容有一個更深刻的了解。 第三部分具體闡述了唐代笞刑、杖刑的具體實施情況。這一部分列舉了很多與笞刑、杖刑相關(guān)的案例，向人們展示了，唐律在對官員執(zhí)行笞刑、杖刑時的特殊規(guī)定，以及對在執(zhí)行笞刑、杖刑中出現(xiàn)的不規(guī)范現(xiàn)象和杖死情況頻繁出現(xiàn)的原因進行分析與總結(jié)。 第四部分則是具體闡述了唐代笞刑、杖刑出現(xiàn)的各種新變化，和對這些新變化出現(xiàn)的原因進行細致的分析，究其原因，正是封建皇權(quán)在司法領(lǐng)域中高于一切的干涉力。本部分還對唐代笞、杖刑對后世身體刑產(chǎn)生的影響做出論述。
[Abstract]:In the Tang Dynasty , the punishment system of the Tang Dynasty was sentenced to five years imprisonment , and the punishment system of Tang Dynasty had been recorded in the same important role in the punishment system of Tang Dynasty .

The first part mainly discusses , from the period of Yao and Shun to Tang this thousand years , flogging , the historical origin and the rheology , the purpose is to master the flogging , the generation and development of punishment .

The second part makes a general statement on the punishment of the flogging and punishment in Tang Dynasty .

In the third part , the detailed description of the implementation of flogging and punishment in Tang Dynasty is described . This part lists a number of cases related to flogging and probation , and shows that the special provisions of Tang Law in the execution of flogging and punishment of officials , as well as the reasons why the irregular phenomenon and the staff death occur frequently in the execution of flogging and probation , are summarized .

The fourth part is a detailed analysis of the new changes of flogging and punishment in Tang Dynasty and the causes of these new changes . The reason is that it is the interference force which is higher than all in the field of justice .
